EASEMENT FOR ROAD PURPOSES
FOR A VALUABLE CONSIDERATION, receipt of which is hereby acknowledged, DENNIS
DECLARK and PATRICIA DECLARK and JOSEPH J. GHIGLIA and MARY C. GHIGLIA hereby
grant to the CITY OF SAN LUIS OBISPO, a Chartered Municipal Corporation, the following described
real property in the City of San Luis Obispo, County of San Luis Obispo, State of California:
An easement for road purposes over the following described real property:
That portion of Lot 9 in Block 17 of the Central Addition to the City of San Luis Obispo, as
recorded in Book A of Maps, at page 54, in the office of the County Recorder, County of San
Luis Obispo, State of California, more particularly described as follows:
Beginning at the most Easterly corner of said Lot 9; thence North 40'15' West along the
Northeasterly line of said Lot 9, a distance of 145 feet; thence South 49 °45' West, parallel with
the Southeasterly line of said lot, a distance of S.' 00 ft; thence South 40'15' East 145 feet to the
Southeasterly line of said Lot 9; thence North 49 °45' East along the Southeasterly line of said lot,
5.00 feet to the point of beginning.

IMPROVEMENTS UPON REQUEST OF CITY

WHEREAS, the undersigned own certain real property commonly known as 79 Benton Way,
San Luis Obispo, CA, and
WHEREAS, the undersigned have requested and been granted a temporary exception by the
Director of Public Works from the requirement of installing certain public improvements on said
property, conditioned upon execution of a covenant by the property owner agreeing to install said
improvements at such time in the future as the city may request same.

NOW THEREFORE, in consideration of the granting of permission to temporarily defer .
installation of certain public improvements consisting of:
City standard sidewalk (5.5 feet wide, integral with the curb & gutter) and driveway ramp,
the undersigned owner(s) of property hereinafter described hereby covenant with the City of San
Luis Obispo to install all of said public improvements without cost to City upon 30 days written
notice from the City of San Luis Obispo requesting that said improvements be installed.
Said roe is located in the City of San Luis Obispo, Count of San Luis Obispo, State of

California, and is described -as follows:
Lot 37, as shown on the map of the Mt. Pleasanton Square, filed for record in the Office of the
County Recorder on November 7, 1923, at Page 34 in Book 3 of Maps, City of San Luis Obispo,
County of San Luis Obispo, State of California.
This covenant shall run with the land and shall be binding upon the undersigned owners, their
heirs, executors, administrators, and assigns.
