COVENANT TO INSTALL PUBLIC
IMPROVEMENTS UPON REQUEST OF CITY
WHEREAS, the undersigned own certain real property commonly known as 1990 Loomis,
and
WHEREAS, the undersigned have requested and been granted,a temporary exception.by-the _
City Council' from the requirement of installing certain public improveriients.on said property
conditioned upon. execution of a covenant by the property owner agreeing to install said
improvements at such time in the future as the city may request same.
NO'VS% THEREFORE, inconsideration of the granting of permission to temporarily defer
installation of certain public improvements consisting of: Sidewalk along the Henderson Avenue
frontage of said property per condition 4 of City. Council Resolution iVo. 8634 (1997 Series) and
Planning Ilse ,Permii A 1.43 -96
The undersigned owners of property hereinafter described hereby covenant with the City of San
Luis Obispo to install all of said public improvements without cost to City upon 30 days written
notice from the City of San Luis Obispo requesting that said improvements be installed.
Said property is located in the City of Sane Luis Obispo, County of San Luis Obispo, State of
California. and is described as follows:
The Easterly 100 feet of Lots 17 and 18 in Block 33 of Phillips Addition to the City of San
Luis Obispo, in the City of San Luis Obispo, County of San Luis Obispo, State of
California, according to map filed for record August 27, 1902 in Book A, Page 162 of
Maps, in the office of the County Recorder of said County, described as follows:
Beginning at the Northeast corner of said Lot 17; thence South along the Easterly line of
said Lots 17 and 18, 60 feet to the Southeast corner of said Lot 18; thence at right angles
Westerly along the Southerly line of said Lot 18, 100 feet; thence at right angles
Northerly, 60 feet to the Northerly line of said Lot 17; thence at right angles Easterly
along said Northerly line, 100 feet to the point of beginning.
2. Assessors Parcel Number: 052- 234 -012
This covenant shall run with the land and shall be binding upon the
heirs, executors, administrators, and assigns.
