Burt, hereby GRANTS to the City of San Luis Obispo, a chartered Municipal Corporation, as
GRANTEE, an irrevocable easement for public street and utilities purposes over a portion of that

LEGAL . DESC'RIPTION
That portion of Hays Street and Dana Avenue, adjacent to Lot 13, Block 42, as shown on the
map of that portion of the Phillips Addition to the City of San Luis Obispo, recorded in Book A
at Page 162, as described in the Resolution of Abandonment [Resolution No.2472 (1973 Series)],
recorded as Document No.24082 in Volume 1736, at Page 37, in the office of the San Luis
Obispo County Recorder, State of California; more particularly described as follows:
A thirty (30) ft -wide strip of land lying south of the centerline of the abandoned Hays
Street, and which terminates at the easterly boundary of the abandoned Dana Avenue, as
depicted below.

CERTIFICATE OF ACCEPTANCE
THIS IS TO CERTIFY that the interest in real property conveyed by DEED OF EASEMENT
(HAYS STREET RIGHT OF WAY) dated January 7, 2003, from Wallace H. Burt, is hereby
accepted by the undersigned officer on behalf of the City Council pursuant to authority conferred by
Resolution No. 5370 (1984 Series), recorded June 15, 1984, in Volume 2604, Official Records,
Page 878, San Luis Obispo County, California, and the Grantee consents to recordation thereof by
its duly authorized officer or his agent.

Subject: Recordation of an easement deed for Hays Street R/W
(Wallace Burt, 2085 Hays Street)
The attached easement document to the City from Wallace Burt accommodates access to an
undeveloped parcel that was cut off from the historical access to Hays St., as the result of the
abandonment of Dana Avenue by the City Council many years ago. This deed covers the south
half of Hays St. (within the abandoned Dana Avenue). I am negotiating for the north half also,
and expect to acquire that easement within a week or so.
Please have the Mayor execute the acceptance certificate, in accordance with the pertinent
resolution authorizing the Mayor's acceptance of same, and record the deed.
Please transmit a recorded copy of the deed, when received.
