COVENANT TO INSTALL PUBLIC
IMPROVEMENTS UPON REQUEST OF CITY
WHEREAS, the undersigned own certain real property commonly known as 2021 and 2023
Swazey, and
WHEREAS, the undersigned have requested and been granted a temporary exception by the
Public Works Director from the requirement of installing certain public improvements on said
property conditioned upon execution of a covenant by the property owner agreeing to install said
improvements at such time in the future as the city may request same.
NOW THEREFORE, in consideration of the granting of pernussion to temporarily defer
installation of certain public improvements consisting of: A sidewalk extension behind the existing
driveway approach per city and ADA standards. The existing approach shall be upgraded or
replaced as necessary to comply with the standards in effect at the time the improvements are
required. The scope of work may include alterations of the existing site improvements.
The undersigned owner(s) of property hereinafter described hereby covenant with the City of San
Luis Obispo to install all of said public improvements without cost to City upon 30 days written
notice from the City of San Luis Obispo requesting that said improvements be installed.
Said property is located in the City of San Luis Obispo, County of San Luis Obispo, State of
California, and is described as follows:

2. Assessors Parcel Number: 003 - 652 -018
3. Commonly known as 2021 and 2023 Swazey
This covenant shall run with the land and shall be binding upon the undersigned owners, their
heirs, executors, administrators, and assigns.

EXHIBIT" A
All that portion of Lots 5 and 6 in Block 187 -B of Ingleside Homestead Tract, in the City of
San Luis Obispo, County of San Luis Obispo, State of California, according to map filed for
record October 11, 1887 in Book A, Page 132 of Maps, in the office of the County
Recorder of said County, described as follows:
Beginning at a point on the East line of said Lot 5, 40 feet South of the Northeast corner of
said Lot;
thence West and parallel with the South line of said Lot, 144.02 feet, more or less, to a
point in the West line of said Lot;
thence South along the West line of said Lots 5 and 6, 38 feet;
thence East and parallel with the South line of said Lot 5, 144.02 feet, more or less, to the
East line of said Lot 6;
thence North along the East line of said Lots 6 and 5, 38 feet to the point of beginning.
Together with that portion of Emily Street abandoned pursuant to Resolution No. 126
