COVENANT TO INSTALL PUBLIC
IMPROVEMENTS UPON REQUEST OF CITY
WHEREAS; the undersigned own certain real property commonly known as 281 Broad
Street in the City of San Luis Obispo, and
WHEREAS, the undersigned have requested and been granted a temporary exception by the
Public Works Director from the requirement of installing certain public improvements on said
property conditionedgpon executign o,a covexiant lax the property owiserTagreeing.to.install said
improvements at such time in the future as the city may request same.
NOW THEREFORE, in consideration of the granting of permission to temporarily defer
installation of certain public improvements consisting of: Curb, gutter, and sidewalk, street
paving and a driveway approach per city and ADA standards. The scope of required
improvements may include grading, retaining walls, drainage, plant removals and street tree
planting associated with the street improvements. Grade and line shall be established by the
owner or by the owner's agent to the satisfaction of the City Engineer.
The undersigned owner(s) of property hereinafter described hereby covenant with the City of San
Luis Obispo to install all of said public improvements without cost to City upon 30 days written
notice from the City of San Luis Obispo requesting that said improvements be installed.
Said property is located in the City of San Luis Obispo, County of San Luis Obispo, State of
California, and is described as follows:
1. That parcel of land described in the Trust Deed recorded as Document No.
2003126080 on file in the Office of the County Recorder of said county. The
parcel is further described in Exhibit One attached.

This covenant shall run with the land and shall be binding upon the undersigned owners, their
heirs, executors, administrators, and assigns.

All that part of the North half of the Southeast quarter of Section 27, Township 30 South, Range 12
East, Mount Diablo Meridian in 'the City, of San Luis Obispo, County of San Luis Obispo, State of
California, described as follows:
Beginning at corner marked "A2" .on West side of Broad Street as shown on a map entitled "Map of
Venable Tract" on file in Map Book 2, Page 13C, of Licensed Surveyors Map, records of San Luis
Obispo County; running thence South 340 50' East 95.50 feet; thence South 290 55' West 162.15
feet; thence South 270 05' East 15 feet; thence South 310 36' West 79.86 feet to a point on the
Northerly line of Lot 2 in Block 6 of Anholm Addition to the City of San Luis Obispo according to the
map thereof filed in the office of the County Recorder of said County, in Book 3, Page 91 of maps;
thence from said point West 746.65 feet to an iron pipe; thence North 39 -1/40 West 5.89 chains to
