WHEREAS, the undersigned own certain real property commonly known as 4450 — 4484
Broad Street in the City of San Luis Obispo, and
WHEREAS, the undersigned have requested and been granted a temporary exception by the
Public Works Director from the requirement of installing certain public improvements on said
property conditioned upon execution of a covenant by the property owner agreeing to install said
improvements at such time in the future as the city may request same.
NOW THEREFORE, in consideration of the granting of permission to temporarily defer
installation of certain public improvements consisting of Public curb, gutter, and sidewalk along
the property frontage. The scope of work shall include the removal of the existing temporary
access driveway in accordance with the project conditions, approved building permit plans,
public improvement plans, city Engineering Standards, and Cal Trans standards. The
temporary barricade for the southerly driveway shall be removed and access provided in
conjunction with the closure of the center drive aisle. A separate encroachment permit will be
required from Cal Trans and the City of San Luis Obispo. A parking lot permit will be
required from the city Building Division for the onsite parking lot modifications. The scope of
work may include but is not limited to additional grading, drainage improvements, plant
removals /plantings, irrigation system alterations, and street tree plantings.
The undersigned owner(s) of property hereinafter described hereby covenant with the City of San
Luis Obispo to install all of said public improvements without cost to City upon 90 days written
notice from the City of San Luis Obispo requesting that said improvements be installed.
Said property is located in the City of San Luis Obispo, County of San Luis Obispo, State of
California, and is described as follows:
That parcel of land described in the Grant Deeds recorded as Doc. No.'s
2006087687 and 2006087688 on file in the Office of the County recorder of said
county.

3. Commonly known as 4450 Broad Street in the City of San Luis Obispo
This covenant shall run with the land and shall be binding upon the undersigned owners, their
heirs, executors, administrators, and assigns.
