BOWEN, as Grantors, hereby grant to the CITY OF SAN LUIS OBISPO, a municipal corporation, San Luis Obispo County, California, as Grantee, the following easement in the County of San Luis Obispo, State of California, to wit: Parcel No. 2. An Easement for sanitary sewer and access roadway purposes over and across that portion of Lot 4 containing 35.42 acres, as laid down and designated upon the map attached to the Decree in Partition rendered out of the Superior Court of San Luis Obispo County, on July 25, 1693, in the action wherein Rebecca Johnson is Plaintiff and William Johnson, et al., Defendants, a certified copy of said decree being recorded August 15, 1892, in Book 20 of Deeds, at page 480, et seq., records of said County, described as follows: Beginning at the Southwest corner of the property conveyed to Vernon Hector Bowen, a single man, by deed dated September 2, 1947, and recorded October 17, 1947, in Book 455 of Official Records, at page 390, records of said County; thence East along the South line of the property so conveyed and the North line of the property conveyed to John H. Bowen and. wife by deed recorded December LH, 1937, in Book 224 of Official Records, at page 293, and by deed re- corded November 16, 1938, in Book 246 of Official Records, at page 493, records of said County, 206 feet to the Northeast corner of property so con- veyed to John H. Bowen and wife by deed recorded November 16, 1938, in Book 246 of Official Records, at page 493, records of said County; thence South along the East line of the property so conveyed 363 feet to the North line of Foothill Boulevard, formerly Bishop Peak Road; thence West along said North line 20 feet; thence North and parallel with the East line of the property so conveyed to John H. Bowen and wife by deed recorded November 16, 1938, in Book 246 of Official Records, at pale 493, records of said County, 323 feet; thence West and parallel with the North line of said Foothill Boulevard, formerly Bishop Pea? Road, 186 feet to the West line of the property conveyed to John H. Bowen and wife by deed recorded March 21, 1949, in Book 315 of Official Records, at page 420, records of said County; thence North along said West line forty (40) feet to the point of beginning. TO HAVE AND TO HOLD said easement for the p-L,7:rpose of acq_uir- ing, constr,uctirg, completing, reconstructing, repairing, main - taining, 'anti operating sanitary sewers and appurtenances, and an access roadway, for said City, together with the right of ingress and egress therefor. The Grantee shall, at its cost and expense, and without delay, restore any improvements damaged or des�royed at any time by reason of the laying of said sanitary sewers and an access roadway, /? /'73 VOL 639 PAGE 591 or by Grantee in maintaining, repairing or operating any sanitary sewer or sewers and an access roadway, in said easement and shall restore the surface of the ground to as near its original con - dition as possible, including an equal distri -ution of cu�face earth. and shall save cite Grantors or any tenant of theirs, from any suits or damages arising from and during tfe construction, or by-mason of maintaining, repairing or operating said sanitary sewer or sewers and an access roadway therein.
