THIS DEED, made this day of , 1953, by and
between the UNITED STATES OF AMERICA (hereinafter c�lled the "Government "),
acting by and through the Housing and Home Finance Administrator (hereinafter
called the "Administrator "), and the City of San Luis Obispo, (hereinafter
called the "City"), WIINESSETH:
WHEREAS, pursuant to the provisions of Public Law No. 849, 76th Congress
approved October 14, 1940, as amended by Public Law No. 42, 77th Congress,
approved April 299 1941, Public Law No. 137, 77th Congress, approved June 28,
1941, Public Law No. 409, 77th Congress, approved January 21, 1942, Public
Law No. 522, 77th Congress, approved April 10, 1942, Public Law No. 119, 78th
Congress, approved July 7, 1943, Public Law No. 150, 78th Congress, approved
July 15, 1943, and Public Law No. 279, 78th Congress, approved April 1, 1944,
(hereinafter called the "Act "), the Government has acquired, under its
Project No. Calif. 4- 151 -F, certain water supply facilities, hereinafter
described, located in the County of San Luis Obispo, State of California; and
WHEREAS, pursuant to the provisions of Public Law No. 152, 81st Congress,
approved June 30, 1949, and Reorganization Plan No. 17 of 1950, effective
May 24, 1950, functions. respecting the utilization and disposition of such
property are vested in the Administrator; and

WHEREAS, the Government, pursuant to the authority conferred by the Act,
and the City entered into a certain Lease of War Public Works, dated as of
January 1, 1945, (WA- bcf -7 -43) under which the City has the option as of

certain dates and for corresponding amounts as shown therein to purchase all

the right, title and interest of the Government in and to such water supply

facilities, provided all accrued rentals have been paid to the date of exercise

WAS, the City has paid all rentals required under said lease in
the aggregate sum of $84,450 and the Government has thereby received the
full option price contemplated under the transaction.
N09P, THEREFORE, KNOW ALL MEN BY THESE PRESENTS:
That the Government, in consideration of the premises and the receipt
by the Government of the aggregate rental payments in the sum of $84,450 paid
to it by the City under the terms of the Lease of War Public Works dated
as of January 1, 1945, and other good and valuable consideration, the
receipt whereof is hereby acknow3e dged, does hereby remise, release and
forever quitclaim unto the City all of the Government's right, title and
interest in and to said water supply facilities, and in and to the real
property and the improvements thereon, together with the appurtenances,
located in the County of San Luis Obispo, State of California, more par-
ticularly described as follows:

as said lot is shown and so designated upon the map attached
to the report of the Commissioners in partition in Action
entitled "Manuel Serrano et al vs. Hiipolito Serrano et al"

State of California in and for the County of San Luis.Obispo,
December 19, 1887, bounded aid more particularly described
as follows:

Perpetual easement of right -of -way for a road to be used in

reconstruct, repair, remove, replace, increase and /or change
the number and /or size of pipes, pipe lines and appurtenances
for the conveyance of water over, under, along and upon the
following described tract:
BEING portions of Lots 1 and 9 of Rancho Potrero de San Luis
Obispo, as said lots are shown and so designated upon the map
attached to the report of the Commissioners-in partition in
Action entitled "Manuel Serrano et al vs. Hipolito Serrano
et al" filed in the office of the Clerk of the Superior Court
of the State of California in and for the County of San Luis
Obispo December 19, 1887, bounded and more particularly de-
scribed as follows:
BEGINNING at Station S -45 of said Rancho as hereinbefore
referred to in the description of Parcel 3; running thence North
83 degrees 35 minutes East along the northerly line of lands now
or formerly of the City of San Luis Obispo a distance of 149.26
feet to a point being the southwesterly corner of land herein -
before described as Parcel 3; thence North 7 degrees 52 minutes
West along the westerly line of said.Parcel 3 a distance of
60 feet to a point; thence South 69 degrees 41 minutes West
145.84 feet to a point; thence South 58 degrees 35 minutes 30
seconds West 16.14 feet to a point; thence South 31 degrees 24

A perpetual easement of right -of -way to construct, operate,
maintain, patrol, reconstruct, repair, remove, replace, in-
crease and /or change the number and /or size and length of pipes.,
pipe lines and appurtenances for the conveyance of water over,
under, along and upon a strip of land of a uniform width of 40
feet and to enter by the United States servants, agents and
employees upon the said 40 -foot strip for the purpose of main-
taining, repairing or replacing said water pipe line provided
that the said pipe line with its appurtenances shall be
constructed and located within the middle 20 feet of the said
40 -foot wide strip of land, said 40 -foot strip being that portion
of Lot 1 of Rancho Potrero de San Luis Obispo as said lot is shown
and so designated upon the map attached to,the report of the Com-
missioners in Partition in action entitled "Manuel Serrano et al vs.
Hipolito Serrano et al" filed in the office of the Clerk of the Sup-
erior Court of the State of California in and for the County of San

replacing said water pipe line provided that the said pipe line
with its appurtenances shall be constructed and located within
the northwesterly 10 feet of the said 25 -foot wide strip, said
25 -foot strip of land being that portion of Lot 9 of Rancho
Potrero de San Luis Obispo as said lot is shown and so designated
upon the map attached to the report of the Commissioners in
Partition in Action entitled "Manuel Serrano et al vs. Hipolito
Serrano et al" filed in the office of the Clerk of the Superior
Court of the State of California in and for the County of San Luis
Obispo December 19, 1887, in the County of San Luis Obispo, State
of California, lying 5 feet on the northwesterly side and 20 feet

in the County of San Luis Obispo, State of California:
That portion of County Road No. 100 described as follows:
COMMENCING at a point on the southerly boundary line of the Rancho
Potrero de San Iuis.Obispo as per Map filed.in Case No. 892 in
the Superior Court of the State of California in and for the County
of San Luis Obispo entitled "Manuel Serrano et al. Plaintiffs, vs.
Hipolito Serrano et al, Defendants," final decree in said case
entered in Book B at Page 339 of Judgments and a copy of said de-
cree being recorded in Book 3 of Deeds at Page 568, Records of
said County; thence in a Northeasterly direction along said County
road to Stake S.459 a point on the line between Lots 1 and 9 as

Southern Pacific Railroad Company in San Luis Obispo County,
California, more particularly described as follows$
A strip of land 10 feet wide lying equally 5 feet each side of
the following described center line:
BEGINNING at a point in the easterly line of the right -of -way
of the Southern Pacific Railroad Company which bears South
82 degrees 15 minutes 48 seconds East 51.5 feet from the center
line of the main track of the Southern Pacific Railroad Com any
(San Francisco to Santa Barbara) at Engineers Station 88306.5;

concrete lined reservoir of approximately 7 -1/2 million gallon capacity,
approximately 1600 feet of 22 inch steel pipe, approximately 2000 feet of
20 inch steel pipe, approximately 2000 feet of 18 inch steel pipe, approxi-
mately 8300 feet of 16 inch steel pipe and 2000 feet of 16 inch cast iron
pipe with meters, valves, fittings, connections, pumps, pump houses,
chlorinating equipment and structures.
