IMPROVEMENTS UPON REQUEST OF CITY

WHEREAS, the undersigned own certain real property commonly known as 1672 Fairview
Street in the City of San Luis Obispo, and
WHEREAS, the undersigned have requested and been granted approval of a temporary
encroachment within the public right -of -way by the Public Works Director. Said encroachment has
been conditioned to honor the location of curb, gutter, and sidewalk to be installed in the future.
Said encroachment has been further conditioned to install public improvements at such time in the
future as the city may request sarrie.' Said agreement shall be recorded prior to or in conjunction
with the'permit`appro, alsfor the tenipoiAfry encroachment:
NOW THEREFORE,' ins consideration of the granting of permission to temporarily'encroach
into the public right -of -way and to defer installation of certain public improvements consisting of:
Curb, gutter, and sidewalk along the property frontage. The scope of work shall include the
required. ADA sidewalk extension behind the driveway approach. The scope of work may
include but is not limited to additional grading, drainage improvements, utility relocations,
plant removals, tree plantings; sidewalk underdrains, and replacement or alterations to the
driveway approach and/or on -site driveway construction.
The undersigned owner of property hereinafter described hereby covenant with the City of San Luis
Obispo to install all of said public improvements without cost to City upon 30 days written notice
from the City of San Luis Obispo requesting that said improvements be installed.
Said property is located in the City of San Luis Obispo, County of San Luis Obispo, State of
California, and is described as follows:
CY SLO Breck Tract Block 2 Lot 11 as recorded in Book 3 of Maps at Page 1 on
file in the Office of the County Recorder of said county.
