RESOLUTION NO. 3897 (1979 Series)
A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
AUTHORIZING THE COMMUNITY DEVELOPMENT DIRECTOR TO ACCEPT
COVENANTS FOR IMPROVEMENTS WITHIN CITY RIGHTS -OF -WAY.
BE IT RESOLVED by the Council of the City of San Luis Obispo as follows:
SECTION 1. This Council hereby authorizes the Community Development
Director to accept covenants allowing construction of temporary improvements
(form agreement attached hereto) on behalf of the City of San Luis Obispo, as
may be necessary from time to time.
On motion of Councilman Bond , seconded by Councilman Dunin ,
and on the following roll call vote:
AYES: Councilmembers Billig, Bond, Dunin, Jorgensen and Mayor Cooper
NOES: None
ABSENT: None
the foregoing resolution was passed and adopted this 3rd day of
July , 1979.

AGREEMENT AFFECTING REAL PROPERTY
PERMIT FOR PLACEMENT OF IMPROVEMENTS WITHIN
THE PUBLIC RIGHT -OF -WAY
FOR AND IN CONSIDERATION of the issuance of Use Permit 34 -80 to establish
a restaurant use at 1901 Santa Barbara Street (hereinafter "the site ") in the
City of San Luis Obispo-,, the undersigned owners of the real property hereinafter
described, hereby covenant with the City of San Luis Obispo that the encroachment
of an existing commercial.structure at the site may continue; renovation of the
existing encroaching building may occur without further encroachment, and no new
encroaching buildings shall be allowed. The location of encroachment on the
site is more particularly described on the plat attached hereto and incorporated
herein by this reference, and marked Exhibit A.
This site .is located in the City of San Luis Obispo, County of San Luis
Obispo, State of California, and is described as follows:
