VE J Whereas, the undersigned own certain real. property commonly known as 1701 Monterey and 1 Whereas, the undersi nedd have requested and been granted a temporary exception by the City Community Sevelopment from the requirement of installing certain public improvements on said property conditioned upon execution of a covenant by the property owner agreeing to install said improvements at such time in the future as the City may request same. NOW THEREFORE, in consideration of the granting of permission to temporarily defer installation of certain public improvements consisting of: Install fire hydrants at the frontage of Parcel A of Parcel Map 84 -305 in accordance with conditions 3 & 13 of director's action No. 84 -5.3 (revised), a.copy af__which is attached to Exhibit A. the undersigned owner(s) of property hereinafter described hereby covenant with the City of San Luis Obispo to install all of said public improvements without cost to City upon thirty (30) days written notice from the City of San Luis Obispo requesting that said improvements be installed. Said property is located in the City of San Luis Obispo, County of San Luis Obispo, State of California, and is described as follows: I.: A.P.N. 01- 151 -01 2. Legal Description. Parcels A & B of Parcel Map 84 -305, recorded in book of parcel maps at page. 3. 1701 Monterey, San Luis Obispo, California This covenant shall run with the land-and shall be binding upon the under' signed owners, their heirs, executors, administrators, and assigns. DATED this 18th day of (Attach Notary Certificate here) t ' r 17 : OUT 1 I( 4 REVISED DIRECTOR'S ACTION NO. $4. -53 AN ACTION OF THE COMMUNITY DEVELOPMENT DIRECTOR OF THE CITY OF SAN LUIS OBISPO GRANTING APPROVAL OF TENTATIVE MAP FOR MINOR SUBDIVISION NO. 84 -305 LOCATED AT 1701 MONTEREY STREET BE IT RESOLVED by the Community Development Director of the City of San Luis Obispo, as follows: SECTION 1. Findings. That the Community Development Director, after consideration of the tentative map of Minor Subdivision 84 -305 and the staff recommendations and reports thereon, makes the following findings: 1. The proposed minor land division map and design are consistent with the general plan. 2. The site is physically suited for the proposed type and density of development which is permitted in the C -T -S and C /OS -5 zones. 3. The design is not likely to cause substantial environmental damage or cause serious health problems. 4. The design of the proposed subdivision will not conflict with public easements for access through or use of property within the proposed subdivision. 5. The proposed parcel map is granted a negative declaration of environmental impact. SECTION 2. Conditions. That the approval of the tentative map for Minor Subdivision 84 -305 be subject to the following conditions: 1. Subdivider shall install the following improvements within Andrews Street right -of =way when further development occurs on Parcel A, unless the street is abandoned, in accordance with city standards and to the approval of the City Engineer (see condition 14): a. Concrete curb and gutter along southerly side of street, and installation of street trees. b. Installation of 6 -foot integral sidewalk along southerly side of street is required, but is hereby deferred, subject to subdivider signing a covenant to install same on 30 days written notice by the City Engineer. C. Pavement for entire street width (total width approximately 36 feet). d. Asphalt swale or curb along northerly edge of paving, as required to prevent erosion or pavement deterioration. C. Hammerhead turnaround area (including paving and concrete curb). VOL 2774 PAGE978 t rR Director's Action No. 84 -53 Page 2 2. Subdivider shall irrevocably offer to dedicate property shown on Exhibit A (attached) for widening of Monterey Street. This offer to dedicate shall be noted on the final map and shall include the following provisions: a. No portion of the area shown on Exhibit A is occupied by permanent buildings on the date of approval of this document (December 28, 1984)• b. Subdivider shall allow removal of on -site improvements other than buildings from the area to be dedicated and may be necessary for widening of Monterey Street upon 60 days written notice from the City Engineer. Improve- ments shall be removed without reimbursement from the city for cost of the improvements or removal. c. City shall not accept dedication of property or remove improvements until the property is needed for road construction and in no case prior to December 28, 1989. 3. Subdivider shall install three fire hydrants along the Monterey Street frontage of the subdivision. Hydrants shall be spaced at approximately 300 -foot intervals to the approval of the Fire Marshal.. 4. Subdivider shall dedicate an easement to the city for drainage and maintenance Purposes over that portion of the subdivision lying between the top of bank of San Luis Creek and the southeasterly property line, to the approval of the City Engineer. 5. Subdivider shall install private on -site drainage improvements to conduct drainage from Parcel B to a suitable point of disposal, to the approval of the City Engineer. 6. Final map shall indicate the.area subject to inundation during a 100 -year design storm. 7. Subdivider shall install street trees along Monterey Street frontage of Parcel A at such time as .street widening occurs, to the approval of the Public Works Department (see Condition 14). 8. Existing driveway ramps along Monterey Street frontage of Parcel A shall be repaired, to the approval of the City Engineer, prior to final map approval. 9. Subdivider shall pay water acreage charges for Parcel B, as calculated by the City Engineer. 10. Subdivider shall record a final parcel map. 11. All new lot corners shall be. staked by a licenses surveyor or registered civil engineer. 1.2. Subdivider shall construct .improvements at the Higuera Street frontage of Parcel B, including continuous curb at the end of the street and reconstruction of existing driveway ramps as-may be necessary, to the approval of the Community Development Department. These improvements may be deferred until development of Parcel B. VOL 2.774 PAGE 979 7 Directors Action No. 84 -53 Page 3 13. Improvements required by Conditions 3, 5., and 8 are hereby found to be necessary for protection of the public health and safety and shall be constructed within 120 days after recording of the final map, except that installation of the fire hydrant(s) at the frontage of Parcel B may be deferred subject to the subdivider signing a covenant to install the hydrant(s) on 30 days written notice by the City Engineer. 14. Improvements required by conditions 1 and 7 may be deferred subject to the subdivider recording an agreement with the city guaranteeing inst.allat.ion of those improvements when further development occurs on Parcel A, unless the street *is abandoned.
