CC -ONEY County Clerk Recorder TWE 1:55 PM San Luis Obispo, CA 93403 -8100 COVENANT TO INSTALL PUBLIC IMPROVEMENTS & POSTPONEMENT OF FIRE HYDRANT FEE i 4:00 r6 /4 6/875381 4 1 1 .00PUT[ �G v 7 'pia �Nlf�kMhlili. dIY141�IN CI` 4 GI- SAN LUIS G�115a WHEREAS, the undersigned owns certain real property commonly known as 1656 Monterey Street, San Luis Obispo, California (Sunbeam Motel), WHEREAS, as a condition of building permit no. 3078 issued by the City of San Luis Obispo on or about 1.2/23/86 , the` undersigned is required to provide for a fire hydrant on the Palm Street frontage:of the property, and replace ten feet of existing driveway approach with standard curb, gutter and sidewalk to the City Engineer's approval; and WHEREAS, the undersigned has requested and been.granted temporary exception by the City Engineer and Fire Chief from the requirement of installing and paying for certain public improvements on said property, conditioned upon execution of the property owner agreeing to install and /or provide for the improvements at such time in the future as stated below. NOW THEREFORE, in consideration of the granting of permission to temporary defer installation and /or payment of certain public improvements consisting of: 1. Replacement of approximately ten feet of the existing driveway approach (northerly side /Monterey frontage) with standard curb, gutter and sidewalk to the satisfaction of the City Engineer; 15 va 3096 PAGE 829 1 2. Payment for materials for a new fire hydrant required within the Palm Street frontage as per approved building plan dated 02/10/87, the undersigned owner of the property hereinafter described hereby covenants with the City of San Luis Obispo to: A. Install the curb, gutter and sidewalk set forth in paragraph 1 4t P. toamJ 10-tti-jo above on or before February 1, 1988. Owner agrees to obtain a permit from the City prior to construction. The undersigned owner further agrees to pay to the City of San Luis Obispo on.or before September 1, 1987 the sum of $2,1� 60.0 as payment for material for ` the new fire hydrant required by paragraph 2 above. Should payment not be made on or before September 1, 1987, this amount is subject to increase if the City Engineer determines that material costs have increased beyond the $2,160.00. The undersigned owner further agrees that should he fail to replace the existing driveway approach or pay for the materials for anew fire hydrant by the dates specified above, he hereby authorizes the City of San Luis Obispo to complete the improvements and agrees to pay for the same. If the City must proceed with these improvements, I agree to deposit the required amount as determined by the City Engineer within two days after receiving written notice thereof. Interest shall accrue at the rate of twelve percent per annum. Should the City of San Luis Obispo seek the advice of an attorney, or attempt to collect any sums due and owing, the undersigned hereby agrees to pay all reasonable attorney's fees; costs and expenses incurred.. Legal Description: Lot 5 and the northeasterly 40 feet of lot 4, block 136, Phillip's Addition to the City of San Luis Obispo, recorded December 19, 1874 in Book A at page 49 of Maps of the County of San Luis Obispo. This covenant shall run with the land, and shall be binding upon the undersigned owners, their heirs, executors, administrators, and assigns. The undersigned agree to indemnify and hold the City of San Luis Obispo; its officers, agents, employees or representatives, from and against any and all claims and /or causes of action which may arise by any reason as a result of the deferral of installation of the above described public improvements.
