AN ORDINANCE PROVIDING FOR
THE ACQUISITION OF CERTAIN
REAL PROPERTY BY THE CITY
OF SAN LUIS OBISPO.
BE IT ORDAINED By tite Council
of the City of San Luis Obispo:
SECTION' 1. That the public in-
terest and necessity requires that
those certain parcels of real prop-
erty hereinafter described be ac-
quired and purchased by the City
of San Luis Obispo from the re-
spective owners, as hereinafter set
forth.
SECTION 2. That the Administra-
tive Officer of the City of San Luis
Obispo is hereby authorized to pur-
chase all of that certain real prop-
erty hereinafter described as Parcels
1 to 6 inclusive for, on and in be-
half of said City of San Luis Obispo,
from Camrose Giurovich as guard-
ian of the person and Estate of
Maggie A. Carby Brown, an incom-
petent person, as to parcels 1 and 2
for the sum of Thirty -five thousand
dollars ($35.000.00), from Fred H.
Johnson and Florence G. Johnson:
his wife, as to parcel 3 for the-sum
of FouS thousand forty-three dollars
($4,043.00), from E. Taylor Smith as
to parcel 4 for the sum of One thou -
sand six hundred dollars ($1,600.00),
from Beni. F. Loveall and Marguerite
F. Loveall, husband and wife,' as to
parcel 5 for the sum of Twelve thou-

MEMORANDUM

FOR: Honorable Mayor and City Council, San Luis Obispo, California
In compliance with directive of Park and Recreation Commission
at their special study session February 9, 1972, the following is
submitted for transmittal to the City Council.
At Council's request the Commission in special session dis-
cussed Senate Bill No. 3027, that would establish 'Lopez Canyon
National Wilderness Area." The discussion was limited to the effect
upon City ownad property ,within the proposed boundaries of the
wilderness area and the impact of the wilderness area'on the
surroundings.
It was the general consensus of the Commission that any action
taken which would limit the City's control of Lopez property was not
in the best interest of the City of San Luis Obispo.
It was pointed out that Senate 3111 No. 3027, Section 1, sub-
section (b) states that non - Federal lands within the stated boundaries
will not be considered as wilderness until acquired by Secretary of
Agriculture. Sub-,ectlon (c) states that Secretary of Agriculture
has authorization to acquire any lands not o'aned by Federal Government
by any means.
In essence, should th3 City Council by resolution or any other
means recommend the inclusion of City property within the wilderness
boundaries, they are saying the City no longer has future plans for
use of this property.
The Grant Deed, dated June 27, 1955, whereby the Sinsholmer
Bros. Corporation gave to the City of San Luis Obispo the Lopez Canyon
property in question, clearly states that the land shall be used for
"public recreation park and /or In connection with the water supply
for the City of San Luis Obispo." Should the City decide for other
use of this property, it would revert back to the Sinsheimer Bros.
Corporation.

BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
That the City Clerk be and he is hereby instructed to
receive and record a deed from Sinsheimer Bros. deeding to
the City of,San Luis Obispo the following described property:
Real property in the County of San Luis Obispo,
State of California, described as follows:
The Southwest quarter of the Southwest quarter
of Section 4; the West half of the Southeast
quarter and the Southeast quarter of the
Southeast quarter of Section 5, and Lot 48 of
Township 31 South, Range 14 East, Mount Diablo
Base ar:d Meridian, in the County of San Luis
Obispo, State of California, according to
the official plat or plats of the survey of
said lands returned to the General Land
Office by the Surveyor General.
