CA SEP 12 1991 FRANCIS M. 000NEY qty Gerk- Recorder TW . 2 :55PM Address: 45 i% Marsh Street APN• 2- 445 -010 1194 Pacific Street 2- 445 -021 CARLSBERG RESOURCES CORPORATION, a California corporation, as Offeror, hereby offers to dedicate, irrevocably, to the CITY OF SAN LUIS OBISPO, a chartered municipal corporation, an easement to establish, public pedestrian access in the City of San Luis Obispo, County of San Luis Obispo, State of California, to wit: Parcel 1 of Parcel Map SL 83 -034 in the City and County of San Luis Obispo, State of California, as per the map recorded October 30, 1986 in Book 40, at Page 30 of Parcel Maps, records of said county, and Parcel 4 in Volume 1510, Page 403 of Official Records in the City and County of San Luis Obispo, State of California, records of said county, and as shown in Exhibit 'A0, attached. PROVIDED HOWEVER that the easement would exclude therefrom, any existing building lying within said pedestrian easement; and OWNER PROPOSES, to construct a pedestrian bridge across San Luis Obispo Creek in accordance with City Use Permit V1413 to provide access to the general public, via the bridge, between Pacific Street and MarsWoro Streets. OFFEROR ALSO AGREES, that no future structures will be allowed within the areas being offered for dedication, unless approved by the Planning Commission of the City of San Luis Obispo pursuant to City Use Permit V1413, or any subsequent amendments. CITY, will be responsible for any future creek trail improvements including any creek modifications. Maintenance and liability of the pedestrian bridge shall be the responsibility of the underlying ownership. Owner shall maintain the bridge in a safe condition. Owner agrees to hold the City harmless of any and all damns or liability arising out of any actions or events occurring on said bridge. EASEMENT TO BE IRREVOCABLE; by Offeror, their heirs, executors, administrators, agents or assigns, and that the City may, at any time accept said offer of dedication, and shall include the general right of access, via paved driveways and parking areas on said property to the subject easement as required to properly construct and maintain the Pedestrian Easements.
