IMPROVEMENTS UPON REQUEST OF CITY r-.- �
WHEREAS, the undersigned own certain real property commonly.
known as 3800 Broad St. - Gas Company Maintenance Facility, and
WHEREAS, the undersigned have requested and been granted a
temporary exception by the City Community Development Director
from the requirement of installing certain public improvements on
said property conditioned upon execution of a covenant by the
property owner agreeing to install said improvements at such time
in the future as the City may request same.
NOW THEREFORE, in consideration of the granting of permission
to temporarily defer installation of certain public improvements
consisting of:
At any time prior to June 5, 1996, Southern California Gas
Company shall install within 90 days of the City's request, a
6 -foot wide concrete sidewalk across the Broad Street
frontage of the project site.
i A.. If the City requests installation of the sidewalk prior
to its widening.of Broad Street, the sidewalk shall be
located as requested by the City within the existing
(110' -1990) right -of -way.
B. Alternatively, at any time prior to June 5, 1996 and in
conjunction with the City's widening of Broad Street and
construction by the City of new Broad.Street improvements
within the expanded right -of -way, Southern California Gas
Company will install at its expense, the sidewalk and
street trees per City standard in cooperation with the
City's construction effort.
The undersigned owner(s) of property hereinafter described
hereby covenant with the City of San Luis Obispo to install all
of said public improvements without cost to the City upon ninety
(90) days written notice from the City of San Luis Obispo
requesting that said improvements be installed.
Said property is located in the City of San Luis Obispo,
County of San Luis Obispo, State of California, and is described
as follows:

2. Legal Description: Lot 95 of the Suburban Tract recorded in
Book 1 of Licensed Surveys at page 92, 3800 Broad Street.
This covenant shall run with the land and shall be binding
upon the undersigned owners, their heirs, executors,
administrators, and assigns.
