Franci &.,M.-Cooney j Recorder - Oct 27, 1993 Time: 08,:00 ;TOTAL 11.00 APN 53- 251 -15 COVENANT AND AFFIDAVIT REGARDING INSTALLATION OF SEPARATE PRIVATE FIRE FACILITIES AND THE USE AND TRANSFER OF OWNERSHIP OF PROPERTY The undersigned represent that they are the sole owners of those parcels of real property situate in the City of San Luis Obispo, County of San Luis Obispo, State of. california, described as follows: A. Parcel 1 of Minor Subdivision 92 -039 as recorded in Book SD of Parcel Maps at Page 41S also known as 3765 S. Higuera Street. B. Parcel 2 of Minor Subdivision-92-039 as recorded in Book $U of Parcel Maps at Page also known as 3795 S. Higuera Street. A common private fire- sprinkler pipeline, connected to a public water main in Higuera Street, serves the structures on Parcels 1 and 2 listed above. The undersigned request that the City of San Luis Obispo allow the existing common fire sprinkler and hydrant piping to serve both parcels until any change in ownership of either parcel or until July 1, 1994 pursuant to an agreement to install the required separate facilities, dated -"7— 3 on file with the City Engineer. The undersigned owners, in consideration of being permitted to utilize one (1) common fire protection system, hereby promise, covenant, and agree to provide a separate fire protection system for each parcel in accordance with plans drawn by Tierra Engineers prior to transfer 'of ownership of either of the above- mentioned parcels. Failure to provide separate connections, at such time, will be considered as a violation of the City Building Regulations and City Subdivision Ordinance and is subject to abatement procedures by the City. This covenant and agreement shall run with the land and shall be binding upon all future owners, heirs and assigns of such properties. The owners hereby agree that they will indemnify, and hold harmless, the City of San Luis Obispo, its officers, employees and agents, from any liability, claim, or damages alleged to be a result of this temporary exception to separate connections. (c) An acknowledgement provided prior to January 1, 1993 and conforming to applicable provisions of former Sections 1189, 1190, 1190a, 1190.1, and 1192, as repealed_ by Chapter 335 of the Statutes of 1990, shall have the same force and effect as if those sections had not been repealed. § 1190. The certificate of acknowledgment of an instrument executed on behalf of an incorporated or unincorporated entity by a duly authorized person in the form specified in Section 1189 shall be prima facia evidence that the instrument is the duly authorized act of the entity named in the instrument and shall be conclusive evidence thereof in favor of any good faith purchaser, lessee, or encumbrancer. "Duly authorized person," with respect to a domestic or foreign corporation, includes the president, vice president, secretary, and assistant secretary of the corporation.
