DEED OF EASEMENT
FOR AND IN CONSIDERATION of the sum of One Dollar ($1.00) to
the grantors in hand paid, the receipt of which is hereby acknowl-
edged, DOLLY LENA ANDRE, EVA ANDRE, PETER ANDRE, HERBERT ANDRE,
JOSEPH J. ANDRE, and GEORGE ANDRE, hereinafter called Grantors,
hereby grant to the CITY OF SAN LUIS OBISPO, a municipal corpora-
tion, hereinafter called Grantee, the perpetual right of way and
easement to lay, maintain, repair, replace, enlarge, operate and
remove a public sewer line and pipe, in and across their parcel of
land in the S. P. McDougall Tract in Block 61, in the City of San
Luis Obispo, County of San Luis Obispo, State of California. Said
easement to be eight feet in width lying four feet on either side
of the following described center line:
BEGINNING at-a point on the southeasterly side of
Dana Street, said point being distant thereon South 370
25' West 28.78 feet from the most northerly corner of
said Lot 19;
RUNNING THENCE from said point of beginning South
520 07' East a distance of 144.63 feet to a point;
thence South 590 37' East a distance of 25 feet more or
less to the southeasterly line of said Lot 19•
It is hereby agreed that Grantors may erect any type of build-
ing they desire over and above said easement, provided however that
no building foundations shall extend lengthwise over said easement.
Provided further that no manholes are to be placed by Grantee on
said property or upon the Dana Street sidewalk adjacent to said
property. Grantee shall connect Grantors' present sewer line with-
out cost to Grantors, and Grantors shall be allowed the privilege
of connecting to the proposed sewer line from any future buildings
that may be located on said land.
Upon completion of the proposed sewer line, the easement
granted to the City of San Luis Obispo by Grantors' predecessor in

interest and recorded in Vol. 85 of Deeds at page 484, Official s
Records of the County of San Luis Obispo, shall be surrendered by
Grantee. Grantee shall be responsible for and shall pay to Grantors
any damage that may be caused by or result from the laying,

maintaining, operation or removal of said sewer line. This agree-
ment shall be binding upon the successors and assigns of the
parties hereto.
IN WITNESS WHEREOF, the Grantors have hereunto set their hands
and signatures this _ 1-2 day of September, 1956.

acknowledged to me that they executed the same.

BE IT RESOLVED by the Council of the City of San Luis Obispo
as follows:
That the City Clerk is hereby authorized to receive and record,
on behalf of the City of San Luis Obispo, a nDeed of Easement" from
Dolly Lena Andre, Lava Andre, Peter Andre, Herbert Andre, Joseph J.
Andre, and George Andrea executed. on 17 September 1956, granting
easement for maintainin and operating sanitary sewers,
PASSED AND ADOPTED this 14th day of September, 1956, by
the following roll call vote:
