EXCHANGE OF PROPERTY
FRED L. GARRETT and the CITY OF SAN LUIS OBISPO, a municipal corporation, do
this —day of 1957, hereby agree to the exchange of property
described herein.
1. FRED L. GARRETT hereby conveys and transfers to, %the CITY OF SAN LUIS OBISPO
the following described property, in the City of San Luis Obispo, County of San
Luis Obispo, State of California, to wit:
In the City of San Luis Obispo, in the Breck Tract, that portion of Lot 16,
Block 2;-Beginning at the Easterly corner of said Lot; thence N 43° 49' W, a
distance of 33 ft to the true point of beginning; thence S 50° 48' W, a distance
of 150 ft; thence S 43° 49' E. a distance of 33 ft; thence S 50° 48' W, a
distance of 36 ft more or less; thence Northerly 15.375 ft along a line parallel
to the Easterly line of the Southern Pacific Company right of way; thence
Westerly 10 ft along a line perpendicular to the'Easterly line of the Southern
Pacific Company right of way; thence Northerly along the Easterly line of the
Southern Pacific Company right of way to the Southerly line of Munoz Street as
shown on the map of the Deleissigues Addition, recorded in Book A. Page 96, in
the office of the County Recorder; thence N 44° 22' E, a distance of 66.50 ft;
thence S 43° 49' E, a distance of 86.60 ft to the true point of beginning.
2. THE CITY OF SAN LUIS OBISPO hereby conveys and transfers to FRED L. GARRET
the following described property, in the City of San Luis Obispo, County of San
Luis Obispo, State of California, to wit:
BEGINNING at the point of intersection of the Northerly line of Johnson Street
with the Easterly line of the Southern Pacific Company right of way; thence'
S 85° 28' E along the Northerly line of Johnson Street, a distance of 122.4
feet to'a point; thence on a curve to the.left, with a radius of 10 feet,
through anangle of 90 °, for a distance of 15.71 feet to a point on the
Westerly line of Munoz Street, a distance of 84.0 feet to a point; thence
N 85° 28' W a distance of 26.0 feet to a point on the Northerly line of the
original Munoz Street as shown on the map of the Deleissigues Addition,
recorded in Book A. Page 96, in the County. Recorders Office; thence S 56° 58' W
along the Northerly line of the original Munoz Street, a distance of 117.04
feet to an angle point on said line;.the�tce S 44° 22' W along the Northerly
line of Munoz Street, a distance of 20.52 feet to the Easterly line of the
Southern Pacific Company right of way; thence S 8° 41' W along said line, a
distance of 6.90 feet to the point of beginning.
EXCEPT THEREFROM an easement to be retained by the City of San Luis Obispo for
the purpose of sloping, and the construction, maintenance, and replacement of C„
waterlines, sewer lines, storm drains, gas lines and other utilities. Said rn

described parcel, and lying between the boundaries of said parcel and the

executed the within instrument, and also known to me to be the persons who
executed the within instrument, and also known to me to be the persons who
executed it on behalf of the CITY OF SAN LUIS OBISPO therein named and they
acknowledged to me that such CITY OF SAN LUIS OBISPO executed the same.

agree to permit FR"D L. M7R.ETT and his wife, FLORENCE V. GAHdETT, during
their lifetime to dump trimmings, cuttings and leaves on said property provided
that said FRED L. GAMETT and /or his wife shall not dump any garbage or junk
and further provided thattheyshall periodically burn said trimnings and do all
things necessary to prevent said trimmings from becoming unsightly or obnoxious.

A RESOLUTION AUTHOPIZING THE E3 :CUTION OF AN
AGREENETSNT AND EXCHANGE OF PROPERTY WITti FRED L.
GARPETT.
BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
1. That the Mayor is hereby authorized to execute on
behalf of the City of San.Luis Obispo that certain "Agreement ",
dated the 10th day of June, 1957, and "Exchange of Property",
dated the 10th day of June, 1957, wherein the City of San Luis
Obispo exchange certain city owned.property with property owned
by Fred L. Garrett in order to provide for the widening of the
Johnson Street Underpass.
PASSSD AND ADOPT -FD this 1st day of July, 1957, by the
following roll call vote:
