• ` DEED OF EASEMENT 3,
THE GENERAL FIREPROOFING COMPANY, a corporation of the State
of Ohio, as Grantor, -hereby grants to the CITY OF SAN LUIS OBISPO, a municipal
corporation, San Luis Obispo County, California, as Grantee, the following easement
in the County of San Luis Obispo, State of California, to wit:
An easement twenty (20) feet wide situated in Section 1, Township 31
South, Range 12 East, Mount Diablo Base and Meridian, City of San Luis Obispo,
State of California, for water line installations, described as follows:
Beginning at the most westerly corner of a tract of land conveyed to
The General Fireproofing Company as shown on a map in Licensed
Surveyor's Book 7, Page 114, in the office of the San Luis Obispo
County Recorder, said corner also being in the easterly right of way
line of the Southern Pacific Railroad; thence S 340 02' E 1176.44 feet
along said easterly right of way line of the Southern Pacific Railroad
to the northerly line of Orcutt Road; thence N 890 09' E 23. 90 feet
along said northerly line of Orcutt Road; thence N 340 02' W. parallel
with the easterly right of way line of the Southern Pacific Railroad
1195. 51 feet to the northerly line of said tract; thence S 390 17t W
along said northerly line 20. 88 feet to the point of beginning.
TO HAVE AND TO HOLD said easement for the purpose of installing,
constructing, reconstructing, repairing, maintaining, enlarging, and operating water
lines and appurtenances for said city, together with the right of ingress and egress
therefor.
Provided, however, that the Grantee shall, at its sole cost and expense,
and without delay, restore any improvements damaged or destroyed at any time by
reason of such installing, constructing, repairing, maintaining and operating said
water lines and appurtenances, and shall restore the surface of the ground to as near
its original condition as possible, including an equal distribution of surface earth,
and shall save the Grantor or any tenant of the Grantor, harmless from any suits or
damages arising from and during the installation or construction, or by reason of
maintaining, repairing, or operating said water lines and appurtenances; and
Provided further that upon written request of the Grantor, its successors
and assigns, the Grantee shall at its sole cost and expense relocate any water lines
and appurtenances which it may install or construct in or upon said premises which
may interfere with the industrial development of said pr emises by the Grantor, its
successors, and assigns, with the continuing stipulation that the Grantor, its suc-
cessors and assigns, without cost to the Grantee, shall furnish and convey to the i=v
Grantee a reasonably suitable substitute location and easement for the construction,
maintenance, and operation of such relocated water lines and appurtenances. co
