MAINO PROPERTIES, a co- partnership, hereby grants to the CITY OF SAN LUIS
OBISPO, a municipal corporation, the following described property in the City of
San Luis Obispo, County of San Luis Obispo, State of California, for alley, sewer
water and utility purposes, to wit:
A portion of Lot 4 and Lot 5, Block B, Tract 66 according to the map
entitled Map of Tract No. 66, Nielsen Roberts Subdivision No. 1. The
property is more particularly described as follows:
Beginning at the southwesterly corner of Lot No. 21, said corner being
the southwesterly corner of Tract No. 66; thence S 890 47' E. along
the southerly line of Tract 66, a distance of 171.99 feet to the true
point of beginning; thence continuing S 89° 47' E, a distance of
103.01 feet to a point; thence N 0° 131 E, a distance of 24 feet; thence
N 89° 47' W. a distance of 118.35 feet to a point on the line common
to Lots 4, 5 and 21; thence S 32° 22' E, along said line, a distance
of 28.48 feet to the true point of beginning.
Grantor further agrees to maintain a public alley of 24 foot width across said
Lot 4 running from Boysen Avenue to said land hereinabove described.
IN YE TNESS WHEREOF, Grantor has hereunto caused its name to be subscribed

AGREEMENT
THIS AGREEMENT made and entered into by and between MAINO PROPERTIES, a
co- partnership, hereinafter called Maino, and the CITY OF SAN LUIS OBISPO, a
municipal corporation, hereinafter called City, WITNESSETH:
Maino agrees to deed to the City for. right -of -way and utility purposes the
land described in the attached deed marked "Exhibit All and hereby assigns as
lessee the land described in "Ekhibit B" which by reference are hereby incor-
porated herein. Maino agrees to maintain said lease and to hold city harmless
from any obligations of said lease. Maino further agrees that if the right to
use said leased lands is terminated by lessor for any reason Maino agrees to
pay for any and all costs involved in acquiring said parcel.
Maino further agrees to hold city.harmless against any and all cost incurred
in moving any telephone or utility poles left in said alley area. Said poles
may have to be relocated at some time in the future and upon receipt of an esti-
mated cost from the utility company, Maino shall deposit said amount with the City
as advance deposit to cover the actual costs incurred.
Maino further agrees to improve said land plus land donated by the City to
city alley standards in accordance with plans and specifications to be.furnished
by the City Engineer. Maino further agrees to improve those portions of the fire
station.parking lot fronting said alley in accordance with said plans and speci-
fications. Upon completion of said improvements to the satisfaction of the City
Engineer, the City agrees to operate and maintain said joint property as a
public alley.
Maino also agrees to provide and maintain an easement of sufficient width
for automobile access from the easterly end of said alley to Boysen Avenue.
The City agrees to provide all necessary engineering, surveying and-inspection
services for the aforementioned improvemments.

being more particularly described as follows:
Beginning at the southwesterly corner of Lot No. 21, said corner
being the southwesterly corner of Tract No. 66, the Nielsen and
Roberts Subdivision No. l; thence S 32° 221.E along the easterly
line of North Chorro Street, a distance of 24 feet to a point;
thence along a curve concave to the right, having a radius of
128.50 feet, thru an angle of 32° 351, and a length of 73.08 feet
to a point on the southerly line of Tract No. 66; thence
N 89° 471 W. a distance of 82.13 feet to the point of beginning.
