PETRICK, hereinafter called Grantors, and the CITY OF SAN LUIS OBISPO, a municipal corporation, hereinafter called City, witnesseth: For and in consideration of the conveyance by Grantors of 0.17 acres more or less lying along Laurel Lane and Orcutt Road, and in consideration of Grantors, or their assigns agreeing to install curb,,_gutter and six foot (61) sidewalk on Laurel Lane and Orcutt Road frontages, the'City agrees to conduct all--necessary engineering and legal work, remove all trees within area to be widened, construct street base and paving to meet new curb and gutter and extend major drainage structure bn Orcutt Road to new property line. It is understood that the City, at itscption, may proceed with the City's portion of the improvement set forth hereinabove at any time the City so desires, but that the City is not under any obligation to do so unless and until the Grantors install their improvements. It is further understood that the Grantors under this agreement need not install their share of said improvements unless and until Grantors erect structures on their property. Petrick AGREEMENT (RESIDENTIAL L&ND SUBDIVIDABLE INTO'FOUR OR LESS LOTS) THIS AGREEMENT, executed this* 7th day of Msy , 19 62 by and between Rufus L. Graves and Dorothy J. Craves, hereinafter called Grantor, and the CITY OF SAN LUIS OBISPO, a municipal corporation, herein- after called City, witnesseth: 1. Grantor shall convey .027 acres more or less, lying along ohnson_Avenue to the City of San Luis Obispo. 2. Grantor agrees to install standard curb, gutter and sidewalk across the entire frontage of the property at the new setback line within 3 months after notice from the City to proceed. 3. Parties agree that the value of the property being conveyed to the City is 0345.00. 4. City agrees to pay Grantor $345.00 after Grantor has installed said improvements, but not before July 1, 1962. 5. Grantor will execute a recordable covenant running with the land for the benefit of the City providing that upon any subsequent subdivision or subdivisions, the owner will reimburse the City $345.00 for all of the above improvements, except an amount equal to the cost of improvements of one normal residential frontage or that parcel retained by the subdivider. If the owner retains a parcel large enough to be subsequently subdivided, then the covenant will continue on such parcel retained and the owner will pay cost of improvements upon each subsequent subdivision of said parcel retained. 6. City will provide all necessary engineering and legal work, relocation of utilities, replacement of landscaping and replace- ment of driveways. 7. The City will revise the existing driveway with red rock and oil to a reasonable grade. City will replace the two Walnut trees with ten gallon-trees of a type selected by the Grantor.
