COVENANT

For good and valuable consideration, the receipt and sufficiency of
which is hereby acknowledged, the undersigned owners.of certain property
hereinafter described hereby covenant with the City of San Luis Obispo
on behalf of said owners, their heirs, executors, administrators and
assigns, as follows:
1. The owners acknowledge that a public sewer easement traverses the
length of said property near the southerly boundary which is four (4) feet
on each side of the center line of the existing sewer pipe. There exists
a concrete pad installed over a portion of said sewer line and the owners
intend to construct a'carport over'a portion of said easement.
2. The City of San Luis Obispo consents to the maintenance of said
concrete pad and the construction and maintenance of said carport and the
undersigned owners hereby covenant and agree as follows:
(a) The owners shall hold the City harmless for any additional
expense or cost involved in the maintenance, repair, addition
or replacement of the sewer line caused by the said concrete
pad or carport, and
(b) At the owner's own cost to repair and replace any improvements
removed by the City during such operations.
3. The owners agree that this covenant shall run with and bind the
land hereinafter described and all subsequent owners thereof and that this
covenant runs in favor of the City of San Luis Obispo, a Municipal Corporation.
4. Said property is located in the City of San Luis Obispo, County of
San Luis Obispo, State of California, and is described in that certain Joint
Tenancy Grant Deed dated May 31, 1961 . recorded as document number 15531 on
July 28, 1961 in Volume 1135, page 573 of the Official Records of San Luis
Obispo County, wherein the undersigned owners acquire fte from Bert L.
Jones and Inez D. Jones.
