.For and in consideration of the permission granted by the City of San
Luis Obispo to the undersigned to build over that certain eight (8) foot
drainage easement, the center line of which is the common boundary line be-
tween Lots 34 and 35, Block A, Tract 208, according to the map recorded on
September 26, 1962 in Book 6, Page 49 of Maps in the Office of the County
Recorder of San Luis Obispo County, the undersigned, COAST VALLEY PROPERTIES
COMPANY, A.Limited Partnership, hereinafter called "Owner," hereby covenants
with the CITY OF SAN LUIS OBISPO, A Municipal Corporation, hereinafter called
"City," as follows:
1. That any foundations or footings to be installed by the Owner over or
within said easement shall be approved in writing by the City Engineer prior
to issuance of any building permit. Such approval shall not relieve Owner of
his obligation to so construct and thereafter"to maintain any structure -to
prevent any interference with or damage to the easement and easement facilities
2.- 'Owners -shall hold City harmless from any additional cost or expense
to the City in the maintenance, repair, replacement or enlargement of the
drainage facilities in said easement'resulting from the permitted construction:
3. Owner hereby releases'City from any damages or claims of damage that
may hereafter result to the building or structure from the City's operation of
their drainage facilities.
4. Owner will promptly repair any damage to the drainage structure re-
sulting from the construction or lack of maintenance of the structure over the
easement and agrees to hold the City harmless and defend the City from any
damages or claims -of damage to others resulting from any interference with the
drainage flow caused by the Owner's construction or lack of maintenance of
such structure.
5. This covenant shall run with the land hereinafter described and shall
be binding upon the Owner, its executors, administrators, assigns -or any
successors in interest.
6. Said property is located in the City of San Luis Obispo, County of
San Luis Obispo, State of California, and is described as Lots 34 and 35,
Block A, Tract 208, in accordance with the map recorded September 26, 1962 in
