HomeMy WebLinkAboutD-454 Foothill BoulevardPAGEZ4 7 C O V E N A N T (RESIDENTIAL LAND SUBDIVIDABLE INTO FOUR PARCELS OR LESS) For good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the undersigned owners of certain property hereinafter described, hereby covenant with the City of San Luis Obispo on behalf of said owners, their heirs, executors, administrators and assigns as follows: 1. The owners hereby covenant with the City that in the event the property is subsequently subdivided into Pour or less lots, the owner will reimburse the City for all of the improvement costs set forth in Paragraph 2 of that certain agreement dated 2jrd day of November , 1962, except an amount equal to the cost of improvements of one normal residential front- age or that parcel retained by the subdivider. If the owner retains a par- cel large enough to be subsequently subdivided, then this covenant will continue on such parcel retained and the owner will pay cost of improvements upon each subsequent subdivision of said parcel retained. 2. The owners further agree that this covenant shall run with and bind the land hereinafter described and all subsequent owners and heirs, executors, administrators and assigns, and that this covenant runs in favor of the City of San Luis Obispo, a municipal corporation. 3. Said land is located in the State of California, County of San Luis Obispo, City of San Luis Obispo and is described as follows: That portion of Lot C of the Breed's Addition according to the map filed January 25, 1889 in Book B Page 33 of Maps in the Office of the County Recorder, San Luis Obispo County, California. The property is more par- ticularly described as follows: BEGINNING at a point marked "B 10" on the above mentioned map; thence North 89° 55' East along the northerly line of the San Luis Obispo -Los Osos Public Road (now known as Foothill Blvd.), a distance of 15 feet to the true point of beginning, thence continuing North 89° 55' East a distance of 134 feet to a point; thence North 0° 15° west a distance of 9.00 feet to a point, thence South 89° 55' West along a line parallel with the Northerly line of said road a distance of 134 feet to a point thence south 0° 15' East a distance of 9.00 feet to the true point of beginning. WEATHERMAN and VIRGINIA C. WEATHERMAN, hereinafter called Grantors, and the CITY OF SAN LUIS OBISPO, a municipal corporation, hereinafter called City, witnesseth: 1. Grantor shall convey 0.028 acres more or less, lying along Foothill Boulevard to the City of San Luis Obispo. 2. City agrees to install curb, gutter, and sidewalk across the entire frontage of the property and to conduct the normal grading that would have been involved at the previous curb line on a standard installation. 3. Parties agree that the value of the property being conveyed to the City is $6482.40 and that in the event the cost of the improvements set forth in Paragraph 2 exceed said value, then the owner will pay said excess at the time of executing this agreement. Said excess amount is 4328.30. 4. City will provide all necessary engineering and legal work, cost of relocation of utilities, replacement of driveways, and grading in excess of the amount that would have occurrred at the old curb line. 5. Grantor will execute a recordable covenant running with the land for the benefit of the City, providing that in the event the pro- perty is subsequently subdivided into four or less lots, the owner will reimburse the City for all of the improvement costs set forth in Paragraph 2 hereof, except an amount equal to the cost of improve- ments of one normal residential frontage or that parcel retained by the subdivider. If the owner retains a parcel large enough to be subsequently subdivided, then the covenant will continue on such parcel retained and the owner will pay cost of improvements upon each subsequent subdivision of said parcel retained.
