COVENANT AND AGREEMENT
This Covenant and Agreement between LAGUNA APARTMENTS ASSOCIATES, a limited part-
nership hereinafter called owner, and the City of San Luis Obispo hereinafter called
city, shall be a covenant running with the land and binding on the owner and all
assigns or successors in interest of the owner of land described as:
Lots 26 and 27 of California Park, in the city of San Luis Obispo,
county of San Luis Obispo, state of California, according to the
map recorded December 2, 1919 in book 2, page 36 of maps in the
office of the county recorder of said county.
EXCEPT therefrom that portion of said land described in the deed
to Robert E. Hickenbottom and Vareen T. Hickenbottom, husband and
wife, recorded May 17, 1951 in book 609, page 575 of Official Re-
cords.
ALSO EXCEPT therefrom that portion of said land described in the
deed to Robert E. Hickenbotton and Vareen T. Hickenbottom, husband
and wife,, recorded May.17, 1951 in book 609, page 576 of Official
Records.
WHEREAS the San Luis Obispo City Planning Commission by Resolution 65 -63 dated
April 16, 1963 granted a variance to the applicant for the subject property
allowing a variance in the parking space requirements for a boding house on
the above described property, subject to the condition that the applicant covenant
with the Citytn replace the 16; parking spaces for which a variance was granted
at a future date should the parking prove inadequate or should a change in the
nature of the occupancy occur, the nature of such occupancy being the use of the
building as a Residence Hall for women students. The Resolution further stated
that the Commission will review the parking provision for this property in three
(3) years and,can at that time require these spaces to be installed and that no
permanent structure shall be constructed within the areas where spaces were
eliminated.
AND, WHEREAS there has been filed with the City of San Luis Obispo a plot plan
showing the location of said parking spaces that may be required by the City of
San Luis .Obispo, it being acknowledged that spaces may be required where land-
scaping and other improvements such as swimming pool are installed and that it may
be necessary to remove such improvements if the Planning Commission determines that
additional parking spaces are needed as set forth in said resolution.
NOW THEREFORE, LAGUNA APARTMENTS ASSOCIATES, a limited partnership, does hereby
covenant and agrge Vith the City of San Luis Obispo that no permanent structure
shall be constructed within the areas where spaces were eliminated and acknowledges
that the Planning Commission has the right to review the parking provision for this
property in three (3) years and can at that time require these spaces to be installed.
This covenant may be recorded in the office of the County Recorder and any subsequent
purchaser or successor in interest shall take title subject to the effects of this
covenant.

to the City of San Luis Obispo, a Political Corporation, is hereby
accepted in accordance with Resolution No. 549 (1959 Series), re-
corded May 26, 1959, in Volurz:e 1002, Official Records, Page 292,
San Luis Obispo County, California, and the grantee consents to
recordation thereof.
