COVENANT
For good and valuable consideration, and in accordance with the conditions
established by the City of San Luis Obispo to the annexation of the property herein-
after described, the undersigned owners hereby covenant with the. City of San Luis
Obispo as follows:
1. That the City of San Luis Obispo is under no obligation to serve water to
those portions of said property lying above elevation 240 feet, according to City
datum.
2. That we further agree to maintain the existing drainage structure over Los
Osos Road adjacent to said property and included Within the annexation thereof until
an alternate drainage structure, approved by the City of San Luis Obispo, is installed
without cost to the City.
This Covenant shall run with the land. hereinafter described and any cost incurred
by the City due to the owner's failure to comply with the above conditions shall, when
confirmed by public hearings duly held by the City Council and recorded, become a
lien on said property. This Covenant shall bind said property and all subsequent
owners, heirs, executors, administrators and assigns, and runs in favor of the City
of San Luis Obispo, a municipal corporation.
Said property is located in the State of California, County of San Luis Obispo,
and is described on the map marked '.'Exhibit A, attached hereto and incorporated
by reference.

said County and State, personally appeared Ray C. Skinner, known to me to be a partner
of Development Associates, a Limited Partnership, known to me to be the person who
executed the within Instrument on behalf of the Partnership therein named, and acknow-
ledged to me that such'Partnership executed the within instrument pursuant to its
Partnership Agreement.
