THIS AGREEMENT, executed this c,�C;) day of 7 , 196431
by and between CLAYTON E. FLUITT and CLAIRE M. FLUITT, hereinafter called Grantors,
and the CITY OF SAN LUIS OBISPO, a municipal corporation, hereinafter called City,
witnesseth:
1. Grantors shall convey .034 acres, more or less, lying along
Johnson Avenue to the City of San Luis Obispo.
2. City agrees to construct sidewalk, curb and gutter across the
entire frontage of-the property being conveyed to the City and to
conduct the normal grading that would have been involved at the
previous curb line on a standard installation.
3. Parties agree that the value of the property being conveyed to the
City is $750.00 and that in event the cost of the improvements set
forth in Paragraph 2 exceed said value, then the Grantors will pay
said excess amount at the time of executing this agreement. Said
excess amount is $375.00.
4. City will provide all necessary engineering and legal work, street
work, relocation of utilities, revise driveways in kind and grading
in excess of the amount that would have occurred at the old curb
line. The City will replace 5 five gallon size junipers and 1 five
gallon size pyracantha or Grantors choice of shrubs of equal value.
The City will also replace 3 fifteen gallon size trees.

THE UNDERSIGNED, Owners of the property hereinafter described,
hereby covenant on behalf of themselves, their successors, administrators or
assigns, to install at their expense, curb, gutter and sidewalk improvements
along the Beebee Street frontage of said parcel when the adjoining lots 1, 3 and
4 are developed, or when Woodbridge Street is improved through to Higuera
Street, whichever occurs first.
Said property is located in the State of California, County of San Luis
Obispo, City of San Luis Obispo, and is described as Lots 1, 2, 3 and 4 of
Block 154 in Harford's Addition. (Assessor's Parcel Number 4- 811 -01)
The above covenant shall run with the land in favor of and shall be
enforceable by the City of San Luis Obispo, a municipal corporation, and is
required as a condition to a requested exception from the City Ordinance re-
quiring such improvements be installed.

CERTIFICATE OF ACCEPTANCE
THIS IS TO CERTIFY that the interest in real property conveyed by
the Covenant dated September 18 , 19 64 ,
from J. J. Silva and Mary J. Silva
to the City of San Luis Obispo, a Political Corporation, is hereby
accepted in accordance with Resolution No. 549 (1959 Series), re-
corded May 26, 1959, in Volume 1002, Official Records, Page 292,
San Luis Obispo County, California, and the grantee consents to
recordation thereof.
