Sti. ings - In.. � s i ;tity and ' pc3 � -%a11 ,F i .r L� 3 c��, PAfiE�3 VD 1' 3854 r DEED FOR VALUE RECEIVED, SHELL OIL COMPANY, a Delaware corporation, hereinafter called "Grantor, " grants to the CITY OF SAN LUIS OBISPO, a Municipal Corporation, hereinafter called "Grantee, " all that real property situated in the City of San Luis Obispo, County of San Luis Obispo, State of California, particularly described as follows: That portion of Lots 1, 2 and 3 of Block 1 of the Norton's Addition as recorded October 24, 1901 in Vol. A, Page 79 of Maps in the County Recorder's Office, County of San Luis Obispo, State of California, described as follows: Beginning.at the most easterly corner of Lot 3, Block 1, thence N 32° 15' W a distance of 177.53 feet to the southerly line of South Street; thence N 890 46' W along the southerly line of South Street a distance of 112.64 feet to the easterly line of Lawton Avenue; thence south along the easterly line of Lawton Avenue a distance of 20.00 feet to a point; theme S 890 46' E along a line parallel to South Street a distance of 113.44 feet to,a point; thence S 320 15' E along line parallel to and 10' westerly of the westerly line of Broad Street a distance of 153.84 feet, to the southerly line of Lot 3 of said Norton's Addition; thence ,S 891 55' E along the southerly line of Lot 3 a distance of 11.84 feet to the point of beginning. Containing .0901 acres more or less. This conveyance is made upon the condition that the above described property shall be used only for the purpose of street, highway, public utility or other public pur- poses -which will not interfere with the access rights of the above described property to the adjoining public streets. In the event Grantee abandons such use or fails to correct a breach of the conditions after ninety (90) days written notice thereof, then Grantor shall have the right to re - purchase said parcel at the then existing market price, to be determined by arbitration if the parties cannot agree. As part of the consideration of this conveyance, Grantee covenants to comply with this condition. Grantor's waiver of any breach of this condition and covenant shall not constitute a waiver of this condition and covenant or of any subsequent breach thereof. This condition and covenant shall run with the land and shall bind and inure to the benefit of the respective successors and assigns Grantor and Grantee. Grantor agrees to convey .0901 acres, more or less, lying along Broad Street and South Street to the City. 2. Grantor agrees to install 8 foot integral sidewalk, curb and gutter along the Broad Street frontage of the property -being conveyed to the City and to install 10 foot integral sidewalk, curb and gutter along the South Street frontage of the property being conveyed to the City. 3. Parties agree the value of the property being conveyed to the City is $4,906.00 and the value of the existing sidewalk, curb and gutter is $1,068.00 making a total of $5,974.00 that the City agrees to pay to the Grantor upon completion of the improvements set forth in Paragraph No. 2. 4.
