BARRETT, hereinafter called Grantor and the CITY OF SAN LUIS OBISPO, a Municipal Corporation, hereinafter called City, witnesseth: 1. Grantor shall convey to the City .128 acres, more or less, lying along jDknson Avenue. 2. City agrees to construct sidewalk,curb and gutter across the entire frontage of the property. 3. City agrees to pay Grantor $3,640.00 for the land being conveyed, less $2,500.00 that it would have cost to construct the improvements at the old curb'.line, leaving a net amount of $1,140.00 the City agrees to pay Grantor upon execution of this agreement. 4. City will provide all necessary engineering and legal work, grading in excess of the amount that would have occurred at the old curb line, slope the yard in back of the new sidewalk, regrade and replace the driveway in kind, relocate utilities as necessary, extend the drainage pipe, construct a drop inlet and pave out the street to the new gutter. 5. In the event the property is subsequently subdivided into ten (10) or more lots within any two (2) year period, the City will be re- imbursed for the cost of all the land acquired by the City ($3,640.00).
