JEAN H. FITZPATRICK and HELEN FITZPATRICR, as Grantors, hereby grant to
the CITY OF SAN LUIS OBISPO, a Municipal Corporation, as Grantee, all of their
right, title and interest in the following described property in the City of San
Luis Obispo, County of San Luis Obispo, State of California, to wit:
That portion of Lot 5 of Block E Tract No. 55 shown on Map recorded in
Book 5 at Page 72 of Maps, San Luis Obispo County Records described as
follows:
Commencing at the Southeast corner of Lot 5 and running thence on
a curve to the left, through an angle of 45° 50' 35" with a radius
of 30', for a distance of 24.00'; thence on a curve to the left,
tangent to a line that bears N 35° 13' 25" E, through an angle of
19° 50' 05 ", with a radius of 30', for a distance of 10.39' to the
Easterly line of Lot 5; thence S 36° 25' E along said line 26.42'
to the point of beginning.
CONTAINING .002 acres, more or less.

AGREEMENT
THIS AGREEMENT, executed this III day of 19659
by and between JEAN H. FITZPATRICK and HELEN FITZPATRICK, hereinafter called Grantors
and the CITY OF SAN LUIS OBISPO, a municipal corporation, hereinafter called City,
witnesseth:
1. Grantors shall convey for street purposes that parcel of property
abutting Gerda Street and designated Parcel A on attached Exhibit A.
2. City agrees to quitclaim and abandon its interest in that portion of
Gerda Street abutting Lot 5, Block 3, Tract 55 and designated Parcel B
on attached Exhibit A.
3. City agrees to remove existing curb and gutter in the bulb abutting the
property and to replace said curb and gutter in a new alignment in
accordance with construction plans approved by the City Engineer. City
further agrees to remove old street paving in that portion of the bulb
to be quitclaimed and abandon, and to place top soil between the old
and the new curb line.
4. The City agrees to remove and reface a portion of the block wall now
existing along the easterly property line in order to meet the back of
the proposed new sidewalk.
5. City agrees to construct a driveway with 3 foot transitions and a 10 foot
bottom dimension across the public right of way near the easterly edge of
the property.
6. City agrees that all work necessary to revise the street grade, curb and
gutter, driveway ramp, and block wall will be done without expense to the
property owner.

GRANT OF EASEMENT
The undersigned, owners of that certain property located in the City of
San Luis Obispo, County of San Luis Obispo, State of California, and described as:
That portion of Block 10 in the City of San Luis Obispo, beginning at the
southerly corner of said Block; thence North 530 07' East 94 feet to the
true point of beginning; thence North 53° 07' East 25 feet; thence North
360 53' West to the centerline of San Luis Obispo Creek; thence southerly
along said centerline to a point that bears North 360 53' West from the
point of beginning; thence South 361 53' East to the point of beginning
hereby grant to the City of San Luis Obispo an easement for the construction,
maintenance, repair, relocation or replacement of a bridge, including any necessary
steps, ramps and appurtenances, and further grant unto the City a ten foot (10) ease-
ment for public sidewalk purposes.
Said easements to be located by the City within the area described as:
That portion of the property described on the attached Exhibit "A" lying
northwesterly of a line parallel to the Higuera Street frontage of said parcel,
said line being 133.5 feet northwesterly of said Higuera Street frontage.
In the event the City determines that either of said easements is not needed
for present or future public purposes, then upon making said determination the City
shall execute quitclaim of either or both easements.
