GRANT DEED
MERVILLE F. SOULES and LEO R. SOWLES, as Grantors, hereby graft to the
CITY OF SAN LUIS OBISPO, a municipal corporation, as Grantee, all of their
right, title and interest in the following described property in the City of
San Luis Obispo, County of San Luis Obispo, State of California, to wit:
That portion of Lot 23 of the San Luis Obispo Surburban Tract,
as surveyed by A. F. Parsons in 1906,'a map of which said survey
was filed in Vol. 79, Page 383 of deeds in the office of the
County Recorder, described as follows:
Beginning at corner S43 at the Southeast corner of Lot 23; thence
on the east line of said Lot N 3° 45' E a distance of 78 feet to
corner S65; thence N 11° 00' W a distance of 622 feet to a point;
thence leaving said Lot line S 72° 30' W a distance of 5.03 feet
to a point; thence S 11° 00' E a distance of 502.77 feet to a
point; thence on a curve to the right with a radius of 760 feet
through an angle of 14 °17' 27" for a length of 189.56 feet to a
point and on the dividing line of Lots 22 and 23; thence S 64° 05' E
along said dividing line a distance of 10.80 feet to the point of
beginning.
Containing .099 acres, more or less.

The undersigned, owners of the property hereinafter described, hereby
covenant with the City of San Luis Obispo on behalf of ourselves, our heirs,
administrators, executors, successors or assigns, that we will install curbs,
gutters, and sidewalks along the southerly 495 feet of the Higuera Street frontage
of said property at such time as the use on said property is changed or expanded,
and further covenant that we will install sidewalk along the northerly 205 feet of
the Higuera Street frontage of said property upon thirty (30) days written notice
from said City.
This Covenant shall run with the land hereinafter described in favor of the
City of San Luis Obispo, a Municipal Corporation, and shall be enforceable by
said City against ourselves, our heirs, administrators, executors, successors
or assigns.
Said property is located in the City of San Luis Obispo, County of San Luis
Obispo, State of California, and more particularly described as:
That portion of Lot 23 of the San Luis Obispo Suburban Tract in the City of San
Luis Obispo, County of San Luis Obispo, State of California, as surveyed by A. F.
Parsons in 1906, a map of which said survey was filed in Volume 79, page 383 of
Deeds, in the Office of the County Recorder of said County, described as follows:
Beginning at corner S43 at the Southeast corner of said Lot and rung thence on
east lines of the lot, N 3 3/40 E 78 feet to corner S65; thence N 11° W, 622 feet
to a stake; thence leaving the lot line, S 72 1/20 W 163 feet to a stake on the east
bank of San Luis Obispo Creek; thence on the east side of said Creek S 18 1/2° E
189 feet to a stake; thence S 35 1/20 E 152.4 feet to a stake; thence S 5 1/40 E
293 feet to a stake in the southerly line of the lot; thence on lot line S 64° 05' E
102.3 feet to the point of beginning.
EXCEPTING THEREFROM that portion of the above described property conveyed
to the City of San Luis Obispo for street widening purposes in that certain Grant
Deed executed by the undersigned parties and recorded concurrently herewith.

THIS AGREEMENT, executed this Afday of Kl� s.uC 19662
by and between MERVILLE F. SOULES and LEO R. SOWLES, hereinafter called Grantors,
and the CITY OF SAN LUIS OBISPO, a Municipal Corporation, hereinafter called City
witnesseth:
1. Grantors agree to convey to the City, at no cost to the City,
.099 acres, more or less, lying along Higuera Street.
2. Grantors agree to install curbs, gutters, and sidewalks across the
frontage of each parcel in accordance with the Covenant to be signed
relative to these parcels.
3. City agrees to pave out the street to meet the new gutter as it is
installed in front of each parcel.

ALBERT H. NELSON, as owner of Parcel 1 hereinafter described, and J.
BARRY SMITH and MABEL I. SMITH, as owners of Parcel 2 hereinafter described,
hereby Covenant with the CITY OF SAN LUIS OBISPO, a Municipal Corporation, as
follows:
1. Said owners, insofar as their respective parcels hereinafter described
are concerned, Covenant to remove the existing curb, gutter and sidewalk and in-
stall base and street paving on Santa Rosa and Montalban Streets in accordance with
City standards to the easterly public right of way boundary on Santa Rosa Street.
2. Said owners further agree to install ten feet (10) of curb, gutter and
sidewalk on the westerly ten feet (10) of their property adjacent to Santa Rosa Street,
including the required curb radius at the corner of Santa Rosa and Montalban Streets
in accordance with City standards, and thereafter to perpetually maintain these im-
provements and to keep said improvements open to the public.
3. This Covenant shall run against the land hereinafter described and in
favor of and enforceable by the City of San Luis Obispo, a municipal corporation,
and shall be binding upon the undersigned owners, their successors, administrators,
executors, heirs and assigns.
4. The property which is to bear the burden of this Covenant is Parcel 1,
owned by Albert H. Nelson, and Parcel 2, owned by J. Barry Smith and Mabel I.
Smith, further described as follows:
That certain property located in the City of San Luis Obispo, County of San
Luis Obispo, State of California., described as:
PARCEL 1: The northwesterly 80 feet of Lot 4, Block 81, Old Town Subdivision.
PARCEL 2: The southerly 69.97 feet of Lot 4, Block 81, Old Town Subdivision.
This Covenant is dated the 22nd day of April, 1966.

The above Covenant is hereby agreed to by SHELL OIL COMPANY, a Delaware
corporation and SHELL OIL COMPANY further agrees to install ten feet (101) of
curb, gutter and sidewalk on the westerly ten feet (10') of their property
adjacent to Santa Rosa Street, including the required curb radius at the
corner of Santa Rosa and Montalban Streets in accordance with City standards,
and thereafter to perpetually maintain these improvements and to keep said
