BAKER, as Grantors, hereby grant to the CITY OF SAN LUIS OBISPO, a Municipal Corporation, as Grantee, an easement for street purposes to travel on, over and across the following described property in the City of San Luis Obispo, County of San Luis Obispo, State of California, to wit: An easement for street purposes over a portion of the northwest one - quarter of the northeast one- quarter of Section 27, Township 30 South, Range 12 East Mount Diablo Meridian in the County of San Luis Obispo, State of California, according to the official plat of said land approved November 30, 1867 by the Surveyor General, said portion to be used for street purposes and described as follows: Beginning at the northeast corner of the land described in the deed to Stanton M. and Gladyce I. Forden recorded in Book 434, Page 427 of San Luis Obispo County Records, thence, along the northerly line of said land South 880 30' 10" West a distance of 612.45 feet to a point on a curve concave southwesterly and having a radius of 128.00 feet, to the True Point of Beginning, a radial line at said point bears North 680 53' 48" East; thence, Northwesterly along said curve through a central angle of 240 00' 52" a distance of 53.65 feet to the beginning of a reverse curve concave northeasterly and having a radius of 324.39 feet; thence, northwesterly along said curve through a central angle of 450 01' 04" a distance of 254.88 feet; thence, North 00 06' 00" West tangent to last mentioned curve 220 feet to a point; thence S 890 54' 02" West a distance of 56.00 feet to a point; thence S 00 06' 00" East a distance of 220.00 feet to the beginning of a tangent curve concave Northeasterly and having a radius of 380.39 feet; thence southeasterly along said curve through a central angle of 340 55' 24" a distance of 231.86 feet to a point which is tangent to the beginning of a curve which is concave Northwesterly and having a radius of 20.00 feet; thence southwesterly along said curve through a central angle of 1230 31' 34" a distance of 43.12 feet to a point; thence along the line tangent to the last mentioned curve south 880 30' 10" west a distance of 52.61 feet to a point; thence south 00 06' 00" east a distance of 28.01 feet to a point on the Westerly prolongation of the Northerly line of the above mentioned land of Stanton hL and Gladyce Forden; thence north 880 30' 10" east along said northerly line and its westerly prolongation a distance of 180.15 feet to the point of beginning. BAKER and CHARLES M. BAKER, hereinafter referred to as "Developer, " and the CITY OF SAN LUIS OBISPO, a Municipal Corporation, hereinafter referred to as "City, " WITNESSETH: REFERENCE IS HEREBY MADE to that certain proposed development of that real property situated in the City of San Luis Obispo, County of San Luis Obispo, State of California, a description of which is shown on the "Plan Development Map" of the Tropicana Village Complex, Unit 2, City of San Luis Obispo, California, as approved by the City Council on the 7th day of February, 1966 by Resolution Number 1524 (1966 Series), subject to the conditions outlined. WHEREAS, the Developer desires that public improvements be approved and accepted for maintenance by the City and does hereby agree to install a sewer main in accordance with City standards and as set forth on the construction plans, and to dedi- cate an easement for said sewer and an easement for Palomar Avenue. Developer shall deposit with City the sum of One hundred twenty -two dollars from which deposit City will pay the salary and expenses of an inspector or inspectors to inspect installation of off site improvements and certify that they have been completed in accordance with the plans and specifications. Any unexpended monies will be returned to said Developer. In the event the inspection fees exceed the sum of $122.00 , the difference is to be paid by City. City reserves the sole discretion in determining the amounts to be paid for salary and expenses of said inspector or inspectors. City agrees to pay for the difference in cost between the eight inch (8') sewer line required by the development and a ten inch (10') line called for in the City's Master Plan. Upon completion of all improvements, City will accept said improvements for maintenance.
