RESOLUTION NC. 1707 (1967 Series)
A RESOLUTION AUTHORIZING ACCEPTANCE AND
RECORDATION CF PROPERTY DAMAGE RELEASE
BE IT RESOLVED by the Council of the City of San Luis Obispo that:
1. The N:ayor of the City of San Luis Obispo is hereby authorized to accept that
certain Property Damage Release executed by Charles E. Ogle on the 8th day of June, 1967,
releasing the City, the Whale Frock Commission, the State of California and others front all
claims for damages to property owned by said Charles E. Ogle, said property being described
in said Property Damage Release.
2. The City Clerk is hereby directed to record said Property Damage Release.
On motion of Councilman Blake, seconded by Councilman Gallagher, and on the
following roll call vote:
AYES: Councilmen Blake, Gallagher, 14 iller, Spring, and IvAyor Whelchel
NOES: None
ABSENT: None
the foregoing Resolution is passed and adopted this 1 Sth day of June, 1967.

PROPERTY DAMAGE RELEASE
Receipt is hereby acknowledged of the sum of ONE THOUSAND DOLLARS
($1, 000.00) paid by the City of San Luis Obispo, a Municipal Corporation, hereinafter
called "City, " in full settlement and discharge for all injury and damage to property
of any kind owned by the undersigned, or in which the undersigned has or claims to
have any interest, located on State Highway 466 near the intersection of said highway
and State Highway No. 1, County of San Luis Obispo, State of California, the concerned
real property being more particularly described in that certain Deed recorded in
Book 1320, Page 710 of Official Records of said County, that has been or will be
incurred by reason of or incidental to the reconstruction, maintenance, operation,
repair and renewal of the Whale Rock Conduit and appurtenances thereto to date by
City, its employees, agents, contractors and subcontractors for which damage the
above named parties are or might be liable.
In consideration of the payment of the above sum, I, by these presents for
myself, my heirs, executors, administrators, and assigns, release and forever
discharge the City, the Whale Rock Commission and its member entities, the State
of California, their employees, agents, contractors and subcontractors, from any
and all claims, demands, damages, actions, causes of action, or suits at law or in
equity, of whatsoever kind or nature, for or because of any matter or thing done,
omitted or suffered to be done by said entities to the above described property to and
including the date hereof and more particularly on account of the activities involved
in the repair of said Whale Rock Conduit at the point where it crosses Morro Creek
during the Fall of 1963 and Spring of 1964, chiefly from on or about December 20, 1963
to about March 14, 1964.
The undersigned understands that neither City nor the other concerned entities,
by reason of agreeing to this compromise payment, admit any liability of any sort, nor
have they made any representations as to liability or made any agreement or promise
to do or omit to do any act of thing not herein set forth.
