AGREEMENT

M
T H I S A G R E E M E N T, executed this 1 tea ` day of 1967,
by and between DOMINIC BRESSI and FRANCES S. BRESSI, Husband and Wife, herein-
after called "Grantors, " and the CITY OF SAN LUIS OBISPO, a Municipal Corporation,
hereinafter called "City:"
WITNESSETH:
1. Grantors hereby agree to grant to City, in the form of an appropriate
Deed of Easement over Assessor's Parcel Number 1 -012 -27, said parcel being more
particularly described in those certain Deeds recorded in Volume 73, Page 152, and
Volume 157, Page 454 of Official Records, County of San Luis Obispo, rights of in-
gress to and egress from certain hereinafter described real property, together with
the right to construct, maintain, operate, patrol, reconstruct, repair, remove,
replace, increase and /or change the number and /or size of pipes, pipelines, hydrants,
accessories and appurtenances for the conveyance and distribution of water under,
along and upon the aforementioned Parcel 1- 012 -27, situate in Section 27, Township
30, Range 12 East, Mount Diablo Meridian, San Luis Obispo County, State of
California.
2. The legal descriptions of the special use area to be described in the
easements which are the subject of this Agreement as the same will appear in the
Deed of Easement to be executed by Grantors are as follows:
A ten foot (10) wide strip of land, the centerline of which is described
subsequent to the True Point of Beginning, as follows:
Commencing at the intersection of the centerlines of Serrano Drive and
Bressi Place as shown upon a Map recorded in Records of Surveys Book
7 at Page 93, records of San Luis Obispo County, State of California;
thence, following the centerline of Bressi Place South 191 321 East 21.13
feet to a point on the Southerly line of Serrano Drive; thence following
the Southerly line of Serrano Drive South 890 21' West 5.28 feet to the
True Point of Beginning; thence, South 191 32' East 434.87 feet to a
point; thence, South 650 28' West 773.84 feet, being the end of the
herein described line.
3. The location of the real property described in Paragraph 2 hereof is
more fully shown on Exhibit "A, " a copy of which is attached hereto and by this
reference incorporated herein.
4. In consideration of the rights, privileges and easements being conveyed
by Grantors, City agrees to pay the sum of One Thousand Two Hundred Eight Dollars
dnd Seventy-One Cents ($1,208.71) upon receipt of a duly acknowledged and fully

executed Deed of Easement describing the above designated parcel in a form accept-
able to the City Attorney. City further agrees to exercise all reasonable care while
working within the area of the easements granted so as to minimize any possible
effect upon the adjacent real property of the Grantor and, upon completion of the
work, City agrees to leave the surface of the area within and adjacent to said ease-
ment in as good condition and repair as existed prior to said work, including
restoration and /or replacement of any pavement or fencing damaged or removed by
City during said work.
5. Grantors further agree to grant to City all of their right, title and
interest in and to the following described real property situate in Section 27, Town-
ship 30, Range 12 East, Mount Diablo Meridian, County of San Luis Obispo, State
of California., together with rights of ingress thereto and egress therefrom, said
property being more particularly described on Exhibit "B" hereto, which said
Exhibit is hereby expressly incorporated herein by reference as though here fully
set forth:
Commencing at the intersection of the centerlines of Serrano Drive
and Bressi Place as shown upon a Map recorded in Records of Surveys
Book 7 at Page 93, records of San Luis Obispo County, State of
California; thence following the centerline of Bressi Place South 19°
32' East a distance of 230 feet to a point; thence, South 700 28' West
a distance of 20 feet to a point; thence, South 190 32' East a distance
of 190 feet to a point; thence, South 651 28' West a distance of 115.44
feet to the True Point of Beginning; thence, from the True Point of
Beginning South 650 28' West a distance of 40.15 feet to a point; thence,
North 190 32' West a distance of 53.50 feet to a point; thence, North
700 28' East a distance of 40 feet to a point; thence, South 19° 32'
East a distance of 50 feet to the True Point of Beginning.
6. In consideration of the rights and privileges to be conveyed by Grantors
pursuant to Paragraph 5 above, City agrees to pay the sum of Two Thousand Five
Hundred Eight -seven Dollars and Fifty Cents ($2, 587.50) upon receipt of a duly
acknowledged and fully executed Grant Deed describing the real property set forth
under said Paragraph 5, in a form acceptable to the City Attorney.
7. The provisions hereof shall inure to the benefit of and bind the heirs,
successors and assigns of the respective parties hereto.
