A G R E E M E N T
THIS AGREEMENT, executed this 18th day of Septenber I
1967 by and between William C. Sodeman and Lorene Sodeman, hereinafter called
Grantors, and the City of San Luis Obispo, a Charter City, hereinafter called City,
Witnesseth:
1. Grantors agree to convey to the City the following described real
property, consisting of .015 acres, more or less, lying along Johnson Avenue;
That portion of Lots 7 and 8 in Block 2 of the Breck
Tract, in the City of San Luis Obispo, County of
San Luis Obispo, State of California, according to
map recorded March 7, 1922 in Book 3 of Maps,
at Page 1, records of said County, described as
follows;
BEGINNING at the intersection of the Northerly
line of Breck Street with the Westerly line of
Johnson Avenue in the City of San Luis Obispo;
thence North 360 22' West along the Westerly
line of Johnson Avenue a distance of 100.00 feet;
thence South 500 48' West along the line between
Lots 6 and 7 in said Block 2, a distance of 6.01
feet to a point; thence South 360 22' East a
distance of 90.48 feet to a point; thence on a
curve to the right with a radius of 15 feet
through an angle of 870 10' for a length of
22.82 feet to a point on the Northerly line of
Breck Street; thence North 500 48' West along
said Northerly line a distance of 15.53 feet
to the Point of Beginning.
2. City agrees to pay Grantors for the property being conveyed the sum of
TWO Thousand Eight Hundred Forty -five Dollars ($2,845.00) in cash. This sum
includes reasonable severance damages to the remainder of the parcel as a result of
the taking. However, no part of this sum shall be considered as a good faith deposit
or down payment, nor shall you, as Sellers, be entitled to any portion thereof until
all of the terms set forth herein have been complied with.
3. Title is to be delivered to the City in the form of a Grant Deed free and
clear of any and all encumbrances. An escrow will be opened with a title company
in the City of San Luis Obispo as soon as this agreement has been executed on behalf
of the City of San Luis Obispo and the parties shall share the escrow fees equally,
provided, however, Sellers shall bear any expense connected with clearing title
to the property.

4. City further agrees to all expense connected with construction of
sidewalk, curb and gutter across the entire frontage of the property being conveyed
to the City and further agrees to provide all necessary engineering work and
coordinate relocation of utilities as necessary, as well as paving the street to the
new gutter.
5. A sketch showing the property to be conveyed by Grantors and the
temporary work area adjacent thereto which it is agreed and understood may be
utilized during the period that the street improvements are being installed is appended
hereto as Exhibit A, which exhibit is hereby incorporated herein by reference.
IN WITNESS whereof the parties hereto have signed this agreement on the
date first above written.
