February 24r 1973 My property at 533 North Broad Streets, where I had lived for 41 years, was severely damaged by the January 18 flood. It is located next to the South bound ramp to 1019 with Garden ereek on one side and Sterner ®reek on the other, these two oreeks in fact are the boundry lines of air property. Both ®reek® were so clogged with debris they overflowed and I had as much as 8 feet of water throughout ny entire property with three to four feet of water in the house, more in'some planes. The house was torn from its foundation and moved 15 to 20 feet away. All sever, gas and eleetrie lines and pipes were torn loose. The inside is eompleteiy damaged, floors buckleds walls craeked, etc. Upon Consulting with a loeal eontraet®r for his recommendation to resetre or rebuild the house on the same location' and in talking to a realtor in reference to selling the property, I understand there have been rumore that the house and/or property are to be sendemned; I are without a home and eannet sell or reloeate until a final decision has been made on this. I have also hired an appraiser Mr. Vrooman and find a great discrepanc'et in the two opinions. my appraiser quoted as the mininum filsure $359000 to $42,000 as the high figure, while your appraiser quoted $22,375. The two local appraisers should know the land values in this area so it doesn't seem logical to have such a vast difference as to the value. I have been looking for property to relocate and find Mr. Vrooman's findings more accurate consid- er.ating the total square feet. I am most anxious to settle my property and willconsider $5,000 less than my original quotation and accept $32,500 for which I may or may not be able .to relocate to a suitable location, Please give this your sincere consideration and advise me. Dear Mr. Gist: In accordance with our conversation of yesterday afternoon, you are hereby authorized to conduct an appraisal for the City of the property known as the 0. W. Koethen property at 533 North. Broad Street in San Luis.Obispo. This is the property near the North Broad entrance to the freeway. The house on the property was recently damaged in the January flood and'most of the property was innundated during that flood. As you point out, the property is bounded on three sides by creeks. If this provides considerable difficulty in estimating the total value of the property, you may wish to separate a value for the creek property from the value of the level part of the property. We will also need some evaluation of the house in its present condition either as salvage value or its net value after the cost of restoring it to its original condition. Notice of Loss - Limitation of Action In addition to the notices required under paragraph 4(b), a statement in writing of any loss or damage for which it is claimed the Company is liable under this policy shall be furnished to the Company within sixty days after such loss or dam- age shall have been determined and no right of action shall accrue to the Insured under this policy until thirty days after such statement shall have been furnished and no recovery shall be had by the In- sured under this policy unless action shall be commenced thereon within five years after expiration of said thirty day period. If the pay- ment does not cover the loss of the In- sured, the Company shall be subrogated to such rights and remedies in the proportion which said payment bears to the amount of said loss. If loss should result from any act of the Insured, such act shall not void this policy, but the Company, in that event, shall be required to pay only that part of any losses insured against hereunder which shall exceed the amount, if any, lost to the Company by reason of the impairment of the right of subrogation. The Insured, if requested by the Company, shall transfer to the Company all rights and remedies against any person or prop- erty necessary in order to perfect such right of subrogation, and shall permit the Company to use the name of the Insured in any transaction or litigation involving such rights or remedies. If the Insured is the owner of the in- debtedness secured by a mortgage covered by this policy, such Insured may release or substitute the personal liability of any debtor or guarantor, or extend or other- wise modify the terms of payment, or release. a portion of the estate or interest from the lien of the mortgage, or release any collateral security for the indebted- ness, provided such act does not result in any loss of priority of the lien of the mortgage. 10. Policy Entire Contract Any action or actions or rights of action that the Insured may have or may bring against the Company arising out of the status of the lien of the mortgage covered by this policy or the title of the estate or interest insured herein must be based on the provisions of this policy.
