ZIMARIK COUNTY RECOROM CONPAREV . i 2 000.,,0 0 ��t + 2���J`.O l j L ET�CROACHI�lENT -- PERMIT AFFECTING REAL- PROPERTY"_EASEMENT_ -_ WHEREAS, the City of San Luis Obispo (hereinafter referred to as City) is the grantee of an easement for drainage purposes dated July 21, 1970, and recorded in Book 1575 at Page 111 of Official Records of the County of San Luis Obispo; and WHEREAS, James A. Renning and Margaret M. Renning are the record owners of the real property described as Lot 1, Tract 401 in the City of San Luis Obispo, according to map thereof recorded July 21, 1970, in Book 7 at Page 45 of Maps; and WHEREAS, said James A. Renning and Margaret M. Renning desire to erect a temporary.wooden structure for driveway decking purposes overlying said easement where it crosses said real property. NOW,, THEREFORE, the parties hereto mutually agree as follows : 1. The City hereby authorizes James-A. Renning and Margaret M. Renning to erect a temporary wooden structure to be used for driveway decking purposes at ground level or above over the easement previously granted to the City and filed July 21, 1970, in Book 1575 at Pag.e'lll of the;Official kecords of the County of San Luis Obispo, along that portion of said easement crossing the real property owned by James A. Renning and Margaret M. Renning and described as Lot.1, Tract 401 in the City.:of San Luis Obispo according to the map thereof recorded July 21, 1970, in Book 7 at Page 45 of Maps. Renning as owners of the above described real property agree to remove any or all of said temporary wooden structure overlying the City's easement whenever requested to do so by the City and at no expense to the City. Said real property owners also agree to hold the City harmless from all liability arising from the acts of all persons upon said easement other than authorized agents of the City. 3. The rights and duties arising from this agreement shall run with the land and shall be binding upon the parties hereto and all their successors in interest. STATE OF California ss.
