EASEMENT
FRED HAMLIN, an individual, hereinafter called "Individual ", hereby
grants to the CITY OF SAN LUIS OBISPO, a public body of the State of
California,. hereinafter called "City ", an easement for a public street,
and for public utilities, within the strip of ;hand situated in the City
of San Luis Obispo, County of San Luis. Obispo, State of California, de-
scribed as follows:
That portion of Railroad Alley referred to as Parcel II and
described at Page 76, Volume 986 of Records on file in the
Office of the County Recorder.
The foregoing grant is made subject to-all liens and encumbrances
which may affect the area described therein, and the word "grant" as used
herein shall not be deemed to be a covenant against the existence of
any thereof.
City agrees.that the.foregoing grant shall be without effect insofar
as the application of any building setback provision of any City ordinance

to any of Individual's facilities on Individual's adjoining lands is Ul
concerned.
In the event that City's use of the area dedicated to'street and
utility purposes.herein shall at any time or times necessitate a re-
arrangement, relocation, reconstruction or removal of any of Individual's
facilities then existing within said area and City shall notify Individual

in writing of such necessity, Individual shall proceed to effect such
rearrangement, relocation, reconstruction or removal, and City agrees to
reimburse Individual for its costs in complying with such notice.
The provisions hereof shall insure to the benefit of and bind the
respective successors and assigns of City and Individual.
IN WITNESS WHEREOF, Individual has executed this instrument this
12th day of June, 1975.

THIS IS TO CE. TIFY that the interest in real property conveyed
by the EASEMENT dated JUNE 12
19 75 , from FRED HAMLIN
to the CITY OF SAN LUIS OBISPO, a Political Corporation, is
hereby accepted by the undersigned officer on behalf of the City
Council pursuant to authority conferred by Resolution No. 549
(1959 Series), recorded May 26, 1959, in Volume 1002, Official
I',ecords, Page 292, San Luis Obispo County, California, and the
Grantee consents to recordation thereof by its duly authorized
officer or his agent.
