SUBJECT:
Consideration of a Supplement to the Local Agency - State Master Agreement
for Federal -Aid Projects for "Bridge Replacement Project - Toro Street at
San Luis Obispo Creek, City Plan No. J -07H."
CAO RECOMMENDATION:
Adopt Resolution Approving Program Supplement No. 9 to the Local Agency -
State Master Agreement for Federal -Aid Projects No. 05 -5016 for "Bridge
Replacement Project - Toro Street at San Luis Obispo Creek, City Plan No.
J -07H."
BACKGROUND
Toro Street Bridge was originally constructed in 1910, and is considered by
State bridge inspectors to be in poor condition and a "functionally obsolete
structure." As a result of the above classification and the structure's level
of deterioration, poor alignment, narrowness, non- standard features and safety
considerations, the city is eligible to receive Federal Bridge Replacement and
Rehabilitation Funds (HBRR) to replace the existing deficient bridge. In
addition, priority no. 3 of "Points of Restricted Capacity - -Four Major Creeks"
of the Flood Management Policy adopted by City Council in June 1983 also
recommended removal or replacement of the bridge because of its restricted
hydraulic capacity. The proposed replacement project consists of removing the
existing concrete bridge structure and abutments and constructing a new
reinforced concrete bridge and abutment wingwalls. The new structure will be
built to current State and Federal standards, with thirty (30) roadway and six
(6) foot sidewalk, a longer span, and significantly improved alignment to
increase the hydraulic capacity, traffic flow, and safety. Plans and
specifications will be submitted to the Council for approval to advertise
subsequent to completion of the state review process.
On June 22, 1978 the Council approved Master- Agreement No. 05 -5016 between the
City and State of California for the expenditure of Federal Highway Funds on
approved City projects. Program Supplement No. 9 to the Master Agreement
designates the Federal HBRR funds that have been allocated and the matching
funds to be provided by the City for this project, and that the City shall be
responsible to advertise, award, and administer the contract. The program
supplement is the documentation required by the Federal Highway Administration
and must be approved by the Council by Resolution in order to encumber the
federal funds and cause such program supplement to be a part of the master
agreement.
SIGNIFICANT IMPACT:
Program Supplement No. 9 designates the total estimated cost for the project to
be $315,000, of which $252,000 is Federal participation (80 %) and $63,000 is
City matching funds (20 %). It is noted that this cost was based on a
preliminary estimate prior to the actual design of the project and is not
current. However state procedure is to approve the Program Supplement,-as

submitted, in order to encumber the allocated Federal HBRR funds. The final
Federal participation and City matching funds that will be required will then
be adjusted after the award of the project and will be based on actual contract
costs. It is noted that the current estimate of cost for this project, which
includes engineering, inspection and construction, is $424,488, of which
$340,000 is the Federal participation and $84,488 are City matching funds.
This project is included in the Capital Reinvestment Plan of the 1987 -89
Financial Plan.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
APPROVING PROGRAM SUPPLEMENT NO. 9 THE LOCAL AGENCY -
STATE AGREEMENT FOR FEDERAL -AID PROJECTS NO. 05 -5016
FOR THE BRIDGE REPLACEMENT PROJECT -
TORO STREET AT SAN LUIS OBISPO CREEK
WHEREAS, the City and the State have entered into Master Agreement No.
05 -5016 for Federal -Aid Projects, and
WHEREAS, Program Supplement No. 9 to the Master Agreement designates the
Federal funds requested and the matching funds to be provided by the City for
preliminary and construction engineering and construction costs for the
project, and that the City shall advertise, award and administer the contract;
and
WHEREAS, the City is eligible to receive Federal Bridge Replacement and
Rehabilitation Funds (HBRR) for this project;
NOW THEREFORE BE IT RESOLVED, that the City Council of the City of San Luis
Obispo, California hereby:
1. Approves Exhibit A attached, entitled "Program Supplement No. 9 to Local
Agency - State Agreement for Federal -Aid Projects No. 05- 5016," and the
Mayor is authorized to execute the same.
2. Directs the City Clerk to transmit the two (2) originals, attaching to each
a copy of the authorizing resolution to:

SPECIAL COVENANTS OR REMARKS
1. All maintenance, involving the physical condition and the
operation of the improvements, referred to in Article VI
MAINTENANCE of the aforementioned Master Agreement will be
performed by the Local Agency at regular intervals or as
required for efficient operation of the completed improvements.
2. In executing this Program Supplemental Agreement the Local
Agency hereby reaffirms the "Nondiscrimination Assurances"
contained in the aformentioned Master Agreement for
Federal -Aid Programs.
3. The Local Agency will advertise, award, and administer this
project and will obtain the State's concurrence prior to
either award or rejection of the contract.
5. The Local Agency agrees the payment of Federal funds will
be limited to the Detail Estimate amounts approved by the
Federal Highway Administration in the Federal -Aid Project
Agreement (PR -2), or its modificaiton (PR -2A), and accepts'
any increases in Exchange Funds, State Matching Funds, and /or
Local Agency Funds as shown on the Finance or Bid Letter or
its modification as prepared by the Division of Local Streets
and Roads.
6. The attached Special Covenants covering the use of Caltrans'
Local Agency Automated Pay System (LAAPS) are applicable to
theis project.

SPECIAL COVENANTS FOR CALTRANS
LOCAL AGENCY AUTOMATED PAY SYSTEM (LAAPS)
Caltrans has granted approval to City of San Luis Obispo 's
request for the use of Caltrans Local Agency Automated Pay System.
A. The City will abide by the requirements as
set forth in the State of California, Department of
Transportation's Policy and Procedure Memorandum P80 -10, dated
March 20, 1980, and as revised February 19, 1981
regarding the use of Caltrans Local Agency Automated Pay System.
B. Attention is called to some pertinent requirements for the use of
LAAPS.
1. Subsequent to the bid opening, the Detail Estimate as based on
the bid of the successful bidder will determine the Local
Agency's share of the construction cost.
(a) Should the Local Agency's share of the construction cost be
greater than the amount on deposit with the State for this
purpose, a supplemental deposit of the difference will be
required prior to the award of the contract.
(b) Any Local Agency Funds on deposit with the State not
required for the Agency's share of the construction cost as
determined by the Detail Estimate will be returned to the
Agency.
2. The Local Agency agrees to provide the following information to
the State upon award of the contract:
(a) Contract award date.
(b) Certification of Contractor's License form for
verification by the State.
(c) Contract approval date and Contractor's first work day.
(d) Contractor's name and the voucher mailing address (for the
warrant) including any subsequent change of address.
(e) Name, address, telephone number and title of the local
agency representative who can accept legal actions filed
against the contract under the Civil Code.
