Gardiner; Chief of Police, by: Captain Bart Topham SUBJECT: AMENDMENT TO SLO M.C. 10.49.030 - "ANIMAL DRAWN VEHICLES IN THE CENTRAL BUSINESS DISTRICT", TO PROHIBIT SUCH VEHICLES AND OTHER NON -MOTOR DRAWN VEHICLES IN THE CENTRAL BUSINESS DISTRICT EXCEPT BY PERMIT. CAD RECOMMENDATION: Introduce ordinance to print to include other non -motor driven vehicles and to be applicable at all hours. MEETING DATE: 10 -4 -BB BACKGROUND: The current regulations prohibit animal drawn vehicles, except by permit, in the central business district between 9am and bpm. There is no ordinance or policy to regulate these vehicles at other times or to regulate pedicabs, rickshaws, or other non -motor driven devices. The increase in year round activities, functions, and events in the central business district (e.g. Thursday Night activities) has led to increased interest in and requests to operate such vehicles and devices, for hire, at various times in the central business district. These vehicles operate in lanes of traffic designed for motor vehicle traffic and would have to stop for passenger loading and unloading in areas designed for motor vehicle parking. While there may be both a time and place for these kinds of vehicles in the central business district, the traffic density, accident volume, sight distancQrissues, and parking considerations make it advisable that we ensure such non - motor vehicle traffic is reasonably regulated and incorporated into downtown traffic patterns in a planned manner that does not adversely impact traffic safety. Alternatives: 1. Take no action, leaving regulations intact as currently written; 2. Repeal regulations to eliminate any prohibition against non -motor driven vehicles; 3. Amend regulations to cover only animal drawn vehicles; or 4. Amend regulations to include all non -motor driven vehicles and all hours. Fiscal Impact: Staff time required to review and process applications. Concurrences: The City Attorney and the Director of Community Development have reviewed the proposed amendment and concur with the recommendation. Recommendations: Select alternative #4 to amend current regulations to allow non -motor driven vehicles in the central business district at all hours pursuant to don permit. B. The Chief of Police shall establish, and make available upon request, administrative procedures and standards for permit processing and approval. C. A non - refundable fee, as established by Council resolution, maq be required with each permit application to defray administrative costs for processinq and inspection. /0 _� ORDINANCE NO. (1988 Series) ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO AMENDING SECTION 1 10.48.030 OF THE SAN LUIS OBISPO MUNICIPAL CODE TO PROHIBIT, EXCEPT BY PERMIT, THE OPERATION OF ANIMAL DRAWN AND NON -MOTOR DRIVEN VEHICLES WITHIN THE CENTRAL BUSINESS DISTRICT. Section 1. Section Number 10.48.030 of the San Luis Obispo Municipal Code is amended to read as set out in Exhibit At attached hereto and incorporated by this reference. Section 2. This amendment, together with the ayes land noes, shall be published once in full at least three (3) days prior to its final passage, in the Telegram - Tribune, a newspaper published and circulated in said City, and the same shall go into effect thirty (30) days after its passage.
