VIWA REGARDING TRANSPORTATION OF CERTAIN // CHEMICALS AND ROCKET FUEL BE IT ORDAINED by the Council of the city of San Luis Obispo as follows: SECTION 1. No person shall transport into or through the City any quantity of chemicals or substances specified as follows: A. Nitrogen tetroxide. B. Red fuming nitric acid. C. Hydazine. D. Rocket fuel, or any chemical components thereof. SECTION 2. Exceptions. This chapter shall not apply to chemicals, materials, or rocket fuels shipped by or for the United States Government for military or national security purposes or which are related to national :defense. Nothing in this chapter shall be construed as requiring the disclosure of any defense information or restricted data as defined by federal law, statute or regulation. SECTION 3. Temporary suspension. Notwithstanding any other provision of this code, the Fire Chief may order the temporary suspension of the transportation of any of the above described material determined to pose an extreme and unreasonable risk to persons residing within the City pending the acquisition of necessary emergency equipment and the preparation of operational plans and emergency procedures. SECTION 4. The Council declares that this Ordinance is necessary as an urgency measure to preserving the public peace, health and safety for the reason that the transportation of rocket fuel and/or its component chemicals through the streets and highways within the City of San Luis Obispo city limits constitutes an extreme and unreasonable risk and danger to City residents and that the danger is one for which the City police and fire departments are not currently equipped to provide an adequate and effective response. SECTION 5. The City Clerk shall cause a summary of this Ordinance, approved by the City Attorney, to be published within five (5) days in a newspaper of general circulation, but delay in publication, or even failure to publish, shall not affect its validity. A copy of the full text of this ordinance shall be on file in the office of the City Clerk on and after the . date following passage and shall be available to any interested member of the public. Congressman Panetta had asked the California Highway Patrol to immediately certify Highway 166, but the California Highway Patrol had rejected that request. Congressman Panetta had sent two telegrams, as follows: 1. To Secretary of the Air Force, Mr. Aldridge, to delay future shipments pending completion of the State hearing process and the certification of Highway 166, assuming the shipments are not in the national security interest; if they are, request the Air Force to temporarily designate 166 as an explosive route pursuant to two code sections, 49USC 1805 and 49USC 1811A. 2. To Secretary of Transportation, John Burnley, asking him to utilize his powers under the same two code sections to temporarily designate Highway 166 as the designated explosive route for the sole purpose of temporarily transporting rocket fuel to Vandenberg Air Force Base. I thanked Congressman Panetta and Gary for their efforts on behalf of the City and others in San Luis Obispo County and indicated that .this information would be forwarded to the City Council .
