OBISTAN-o ___-__=_v' 990 Palm Street/Post Office Box 8100 • San Luis Obispo, CA 93403-8100 March 10, 1988 MEMORANDUM TO: City Council FROM: Ron Dunin, Mayor SUBJECT: Appointments to the Housing Authority As per Roger's recent memo (copy attached) , I have reviewed the applications on file for the Housing Authority vacancies and would like to recommend the following for reappointment: Ruth Wirshup - reappointment (term to expire 3/31/92) Leland Balatti - reappointment (term to expire 3/31/92) It is my feeling that considering the complexity of the issues that the Housing Authority reviews, that members have the length of time to become familiar with its legislative powers and responsibilities. I have talked with George Moylan, Executive Director, in this regard and he concurs with my recommendations to maintain continuity on the commission at this time. Copies of the recommended applications are attached. The controlling law for housing huthorities is found in the State of - California Health and Safety Code, Sections 34200,et seq. ("Housing Authorities Law") . Basically, the state has enabled that residing dormant in each city is a separate body corporate known as a housing authority and capable of specific functions. This body is brought to life by the city declaring the need for such an authority and taking certain implementation steps. A city under housing authority law is an agency of the state functioning under state law and is not acting pursuant to fundamental law to achieve solely municipal objectives (Housing Authority v. City of Los Angeles (1952) 243 P.2d 515) . This is similar to the role of a city when functioning as a redevelopment agency or in annexation matters. Section 34270 provides that the Mayor (if directly elected) shall appoint persons as commissioners of the Authority, subject to confirmation of a majority of the members of the Council . The Mayor shall appoint two additional commissioners who are tenants of the Authority if the Authority has tenants. One such tenant commissioner shall be over 62 years of age it the Authority has tenants of such age. ft should be noted that any requirement that a commissioner be a resident of the city is not valid since the commissioner is acting as a state agent and not a city official In the normal sense (21 Cal . Atty. Gen. Ops. 40) . The terms of commissioners is 4 years, except tenant commissioners' terms are two years (Section 34272) . Removal of commissioners prior to expiration of their term is provided for by Section 34282 and can only be for specific grounds (inefficiency, neglect of duty or misconduct in office) . A Housing Authority commissioner is not an "at will" appointment. Our Advisory Body Handbook is generally consistent with the above statutes regarding the Housing Authority with the exception that we provide that ' r Honorable Mayor and Members of the City Council January 27, 1988 Page 2 all 7 commissioners are appointed by the City Council. Also, we have been adhering to the general residency requirement applicable to all advisory bodies. It is recommended that we bring our procedures into compliance with state law by having the 5 general appointments made by the Mayor, subject to confirmation of the majority of the Council, and the tenant appointments made directly by the Mayor alone.
