SUBJECT
Time extension for Tract 1261 - a single-family residential subdivision creating or
adjusting seven lots on Rosita Street between Foothill Boulevard and Cerro Romauldo
Avenue.
CAO RECOMMENDATION
Adopt the attached resolution to approve a one-year time extension, as requested.
BACKGROUND:
Situation
In April 1985 the City Council approved the tentative map for this tract, which creates
lots around several existing houses (see map) and which needed several design exceptions
(see resolutions No. 565). Under state and city subdivision rules, a final map must be
filed within two years of tentative map approval, or the subdivider must obtain approval
of a time extension. The council approved a one-year extension in March 1987.
Data Summary
Address: 133 Rosita Street
Subdivider: Brown Family Estate Trust
Representative: Contract Survey and Design
Zoning: R-1
Land Use Element map: Low-density residential
Environmental status: City Council approved a negative declaration 3-2-85.
The property owners have begun installation of public improvements but they probably
won't be complete before the expiration date. They would prefer to get a time extension
and complete the improvements before filing the final map rather than bonding and filing
the final map now (see attached letter).
There have been no changes in the project nor to relevant policies or ordinances since
the original approval. Therefore, staff sees no reason to deny this time extension. The
subdivider has submitted a final map for checking and, as noted above, the owners have
begun to install subdivision improvements.
The council may approve or deny the time extension. The council may not add, delete, or
modify conditions.

CONSEQUENCES OF NOT TAKING ACTION:
Map may expire and applicant would have to reapply if it does. Alternatively, the
applicant could file final map and bond for incomplete improvements. There is no
apparent practical benefit to the city from that approach.

Subject: Time extension for Tract 1261
Dear Ken:
According to our records, we are approaching the expiration
date of the tentative map for Tract 1261 in San Luis Obispo.
Mr. and Mrs. Brown have completed most of the improvements,
however, they are not at this time in a position to complete
the remaining portion and therefore they will not be able to
record the map before the expiration date of April 2 , 1988 .
Since they are not going to bond for the improvements and it
does not seem feasible that construction will end before the
expiration date, we request an extension of one (1) year.
Enclosed is a check for the $100. 00 fee as required. If you
have any questions, please give me a call.
,o-)Sincere y,
