CAO RECOMMENDATION: Adopt Ordinance No. : the City Attorney recommends this on an urgency basis to avoid conflicting standards and unnecessary confusion. BACKGROUND: Discussion Last fall, a number of changes to the Zoning Ordinance were recommended to the City Council by staff and the Planning Commission. Among those were changes relating the density calculation to the size of units. A corresponding change to the parking regulations were also recommended relating the required number of parking spaces to unit size as well. When the Council first reviewed these in October, there was little discussion about the recommended limits on unit size. There was, however, considerable debate about how the floor area (ie: unit size) should be measured. Thus, that eleme^,t of the recommendation was continued. The Council recalls how subsequently the size limits were reconsidered and considerable public interest was generated thereby. (The Council changed, too.) The amendments relating density to unit size were put on hold pending more community discussion (a public workshop is now scheduled for March 19). Curiously, the change tying parking standards to unit size, which is in another chapter and section of the code, was in fact passed by the Council and became law sometime in December, despite the fact that the item which instigated this amendment (unit size and density) never was adopted. It would have been better to have not adopted the amendment to the parking standards unless and until the corresponding amendment to density calculations was adopted; but, at the time, the concern was simply in the way floor area would be counted not in the concept or in the size limits. That changed only after the amendment to the parking standards was actually adopted. To avoid confusion, and to be fair to applicants, this amendment to parking standards which was really another part of the density calculations issue, which is still being worked on, should be suspended until the density and unit size issue is resolved. Given the potential for confusion and inequity, the City Attorney has suggested that this be adopted on an urgency basis so that it can take effect immediately. ►�n��n�►i�lliilpllhi��p� city of San Luis OBlspo ONGs COUNCIL AGENDA REPORT Page 2 Significant lmnacts: None. Conseauences of Not Taking Recommended Action: Considerable confusion may ensue and the interested public which has been told the changes are still being worked on may feel that there is some deception if the amendment relating parking standards to unit size is actually implemented. (1988 Series) AN URGENCY ORDINANCE OF THE CITY OF SAN LUIS OBISPO SUSPENDING THE IMPLEMENTATION OF A PART OF ORDINANCE NO. 1102 RELATING PARKING STANDARDS TO UNIT SIZE WHEREAS, on October 20, 1987. the City Council did adopt Ordinance No. 1102 which did amend various sections of the Zoning Ordinance including Table 6 within Section' 17.16.060 which lists parking requirements by use; and WHEREAS, among the adopted changes was a modification to the requirements for dwellings which related parking standards not only to the number of•bedrooms but also to unit size; these changes were included on pages 7-8 of Exhibit "A" referenced in Ordinance No. 1102; and , WHEREAS, aforementioned changes to the parking standards were to correspond with concurrent changes to the density standards; and WHEREAS, the changes to the density standards were not adopted pending further public input and review; and WHEREAS, the intent was clearly to have.the two sections correspond; and WHEREAS, there is consequently considerable potential for confusion and inequity in implementing the aforementioned parking standard changes. NOW, THEREFORE, BE ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. That the,above mentioned changes to the parking standards adopted by Ordinance No. 1102 and illustrated on attachment "A" hereto shall be suspended indefinitely and the parking standards for dwellings in effect prior to adoption of Ordinance No. 1102 shall remain in effect. SECTION 2.
