SUBJECT:
GP/CR 1368: General plan amendment and rezoning to change the land use element map from
Interim Conservation/Open Space to Low-density Residential, and to adjust the urban
reserve line and zoning boundary, for a 7.5-acre parcel beyond the southerly end of Royal
Way.
CAO RECOMMENDATION:
Adopt a resolution changing the general plan map and introduce an ordinance amending the
zoning map, as recommended by the Planning Commission.
BACKGROUND:
DISCUSSION
The site is zoned R-1-S (low-density residential), and designated "Interim
Conservation/Open Space" on the land use element map. The Land Use Element map says that
Interim Conservation/Open Space "is the designation given areas which will be kept open
until urbanization is appropriate, such as the expansion areas outside the present city
limits. Specific proposals for these areas must be approved along with the change to an
urban land use designation."
The council in 1983 changed the zoning map for the site to R-1-S, as part of the city's
Hillside Planning Program, and changed the general plan map to Interim Conservation/Open
Space, with an urban reserve line roughly defined by natural features (slope boundaries,
creek centerline).
The tentative map for a subdivision was approved for the site and adjacent property to
the south (a total of 11.27 acres) on March 15, 1988. A "specific proposal" has
therefore been approved. The total subdivision involved dedication of an open space
easement over the steeper portions of the property, adjacent to the city limits, and will
include improvements to the scarred hillside and the creek tributary. The open space
easement line follows closely the existing zoning boundary between R-1-S and C/OS-40,
which is identical to the urban reserve line (URL), which defines the limit for
development in the city.
The council initiated an amendment to the general plan land use map and zoning map on
March 15, to change the general plan map designation to "Low-Density Residential", and to
adjust the zoning boundary and URL to the more accurately-defined open space easement
line.
On May 25, 1988, the Planning Commission reviewed this item and unanimously recommended
approval. This is largely a "clean-up" item, reflecting earlier action approving the
tract and concurrent open space easements.

SIGNIFICANT IMPACTS
Environmental: The environmental initial study uncovered no significant environmental
impacts that could not be mitigated.
Fiscal: The change in map designation will allow development of Tract 1438, which
includes open space easements and an easement over the creek for maintenance purposes.
The city will not be responsible for maintenance of the open space areas. The city
routinely provides maintenance for all creek areas where it has access. The easement
will formalize access for this purpose. Expenses from doing this work are not expected
to be significantly different than those currently incurred.
CONSEQUENCES OF NOT TAKING THE RECOMMENDED ACTION
If the council denies the amendment, the final map for the approved subdivision will not
be approved, and the subdivision will not be developed. The property owner will not be
able to develop the site until the zoning map is consistent with the general plan map.
RECOMMENDATION
Adopt a resolution changing the general plan map and introduce an ordinance amending the
zoning map, as recommended by the Planning Commission.

AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO AMENDING
THE OFFICIAL ZONE MAP OF THE CITY TO ADJUST THE ZONING BOUNDARY
BETWEEN THE R-1-S AND THE C/OS-40 ZONES BEYOND THE
SOUTHERLY END OF ROYAL WAY (GP/CR 1368)
WHEREAS, the Planning Commission and the City Council have held hearings to consider
an appropriate zoning boundary on the property in accordance with Section 65800 et. seq.
of the Government Code; and
WHEREAS, the City Council finds that the proposed zoning boundary is consistent with
the general plan; and
WHEREAS, the rezoning has been evaluated in accordance with the California
Environmental Quality Act and the city's Environmental Impact Guidelines, and a negative
declaration has been granted by the city; and
WHEREAS, the proposed zoning boundary promotes the public health, safety, and
general welfare.
BE IT ORDAINED by the Council of the City of San Luis Obispo as follows:
SECTION 1. Following the city's Environmental Guidelines, the project's negative
declaration is hereby affirmed.
SECTION 2. That the zoning boundary between the Conservation/Open Space and
Low-Density Residential zones on property at 2000 Royal Way be adjusted to be
coincidental with the open space casement lines for approved tentative tract 1438, as
shown on the attached zoning map.
SECTION 3. This ordinance, together with the ayes and noes, shall be published once
in full, at least three (3) days prior to its final passage, in the Telegram-Tribune, a
newspaper published and circulated in said city, and the same shall go into effect at the
expiration of thirty (30) days after its said passage.

TO LOW-DENSITY RESIDENTIAL, AND ADJUSTING THE URBAN RESERVE LINE,
FOR PROPERTY BEYOND THE SOUTHERLY END OF ROYAL WAY (GP/CR 1368)
WHEREAS, the Planning Commission and City Council have held hearings to consider
amendment to the General Plan Land Use Element Map in compliance with the Government
Code; and
WHEREAS, the amendment has been evaluated in accordance with the California
Environmental Quality Act and the city's Environmental Impact Procedures and Guidelines,
and the request to change the land use element map to Low-Density Residential for
property at 2000 Royal Way and adjust the urban reserve line poses no adverse impacts on
the environment and has been granted a negative declaration by the Community Development
Director, and
WHEREAS, the amendment is appropriate at the proposed location and will be
compatible with surrounding land uses; and
WHEREAS, the proposed amendment is consistent with the city's general plan;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo as
follows;
SECTION 1. The determinations of the Community Development Director concerning
environmental documents are hereby affirmed.
SECTION 2. The Land Use Element map is hereby amended as shown on the attached
exhibit.
SECTION 3. The Community Development Director shall cause changes to be made in
publications and maps which are available to the public and displays in City Hall.
SECTION 4. This action shall take effect thirty (30) days from the date of adoption
of this resolution.

I. PROJECT DESCRIPTION AND ENVIRONMENTAL SETTING
The project includes a change to the general plan land-use designation of approximately
7-1/4 acres near the southerly city limits beyond the existing end of Royal Way, from
Interim Conservation/Open Space to Low-density Residential, and the adjustment of the
urban reserve line between Low-density Residential and Conservation/Open Space.
1I. POTENTIAL IMPACT REVIEW
The physical changes likely to result from development of this site, consistent with the
new land use designation, have been reviewed as part of the review of a tentative
subdivision map for the site. The environmental review for that tract (Tract 1438),
numbered ER 47-87, available for review in the Community Development Department, is
incorporated in this report by reference.
Land use element: . The general plan land use designation for the site is currently
Interim Conservation/Open Space. The land use element map says this designation is given
areas "which will be kept open until urbanization is appropriate, such as the expansion
areas outside the present city limits. Specific proposals for these areas must be
approved along with the change to an urban land use designation."
The zoning map designation is R-1-S (Low-dcnsity Residential, with Special
Considerations).
The current land use designation is a "holding zone" for an urban land use designation.
A tentative map has been approved for a subdivision on the site. Therefore, since a
specific proposal for the area has been approved, a change to the land-use designation is
appropriate. State law requires that zoning and general plan map designations be
consistent with each other. The change to Low-dcnsity Residential will be consistent
with current zoning for the property.
The proposed adjustment to the Urban Reserve Line (URL) is to make the URL coincide with
the boundaries of an open space casement to be dedicated to the city as part of Tract
1438. The change will refine the line's location, more closely defining development
limits for the subdivision (no buildings may be built beyond the URL).
No adverse environmental effects arc expected from approval of these change.
RECOMMENDATION
Grant a negative declaration of environmental impact.
