SUBJECT:
Acceptance of Tank Farm Road/SPRR Underpass - EDNA-ISLAY area (Pacifica
Corp. , subdivider)
CAO RECOMMENDATION:
Adopt Resolution accepting Tank Farm Road/SPRR Underpass
DISCUSSION:
The subdivider/developer of the Islay area of the Edna-Islay Specific Plan has
completed the new railroad bridge over Tank Farm Road, and has asked the City
to accept it for maintenance and operation. The work has been approved by the
Southern Pacific Transportation Co. and has been used for railroad purposes for
several months. The bridge structure is to be maintained by the City with
Southern Pacific responsible for the ballast, tracks, signals, etc. in
accordance with an existing agreement between the City and Southern Pacific
Transportation Co.
Landscaping of the slopes are requirements of the respective adjacent tracts.
The street improvements are separate from the bridge structure and since Tank
Farm Road is not yet constructed easterly of the railroad, public traffic will
not be utilizing this underpass until later this year.
Faithful Performance and Labor & Materials bonds in the amounts of 1 .1 million
and 550,000 dollars, respectively, were posted by the subdivider. Acceptance of
the work will allow release of 90% of the Performance Bond and 100`6 of the
Labor & Materials Bond per the Developer's Agreement.
ALTERNATIVES:
Option 1 . Adopt resolution accepting the Tank Farm Road/SPRR Railroad
Undercrossing and releasing 90% of the Faithful Performance Bond and the
Labor & Materials Bond in accordance with the Developer's Agreement.
The primary advantage would be to eliminate the bonding requirement for the
completed work.
Option 2. Postpone acceptance until completion and acceptance of Tank Farm
Road improvements, but reduce the Performance Bond to 10% to guarantee the
work for one ( 1 ) year after future acceptance.
An advantage would be to postpone the maintenance responsibility, although
the City is responsible to the SPRR per an agreement and the trains are
already using the bridge. Another advantage would be the subdivider would
be required to maintain the structure for a longer period of time even
though the structure is complete.

CONSEQUENCES OF NOT TAKING THE RECOMMENDED ACTION:
Requires the subdivider to maintain the structure and bonds for a longer
period even though the structure is complete.
FISCAL IMPACT:
There is no annual maintenance required for the structure. There will be
minimal landscape maintenance associated with the Tank Farm Road parkway in
the near future.
CONCURRENCES:
The Community Development Director and City Attorney concur with the
recommendation. No department has expressed any opposition.
RECOMMENDATION:
Adopt resolution accepting the Tank Farm Road/SPRR Undercrossing and releasing
90% of the Faithful Performance Bond and the Labor & Materials Bond in
accordance with the Developer's Agreement.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
ACCEPTING THE TANK FARM ROAD/SPRR UNDERCROSSING - EDNA/ISLAY AREA
(THE PACIFICA CORPORATION)
WHEREAS, the City Council entered into an agreement with Pacific
Ventures, a California Joint Venture, on August 19, 1986 pursuant to
Resolution No. 6054 (1986 Series) which provided for the construction of a
railroad underpass for Tank Farm Road, and
WHEREAS, The Pacifica Corporation assumed the responsibilities of Pacific
Ventures as Successor -In-Interest , and
WHEREAS, The Pacifica Corporation has completed the railroad underpass to
the satisfaction of the City and the Southern Pacific Transportation Company
and has asked the City to accept the bridge,
NOW THEREFORE BE IT RESOLVED that the Council hereby accepts the Tank
Farm Road Bridge (SPRR Undercrossing) for maintenance and operation. The
Faithful Performance Bond is hereby reduced to $110,000 to be held for one
(1 ) year as a warranty per the Developer's Agreement. The Labor & Materials
Bond is released in accordance with the California Civil Code of Procedures.

This letter is to inform you that the construction of
the railroad overpass for Tank Farm Road is completed.
We hereby request the City to accept the structure at
the next regular Council meeting and start the 1 year
warranty period effective the date of said acceptance.
We also respectfully request a reduction of the posted
bond to 10% of the original amount (or $110,000) effective
that same date. I am enclosing a copy of the original bond
for your information.
