SUBJECT: Conditional Gift of Excess Campaign Funds
SUMMARY RECOMMENDATIONS:
Accept gift with conditions from Mayor Dunin of excess campaign funds.
BACKGROUND:
I was reelected to office in November, 1987. I did not expend all of my
campaign funds. Under City election campaign regulations (SLOMC Chap. 2.40) .
surplus campaign funds must be disbursed to the City "and/or nonprofit organi-
zations of the campaign treasurer's choice. " (SLOMC Chap. 2.40.060(E) ) .
I (and, of course, my campaign treasurer) would like to donate the entire
surplus fund amount of $833.40 to the City to be used for yet to be specified
purposes. Namely. I propose that the funds could only be spent at the
direction of the Mayor for special programs. Legally. the funds would have to
be spent on bona fide municipal purposes.
The Council may accept the gift of $833.40 with the attached condition that the
Mayor shall be the official who decides how and where the funds are spent. If
Council declines the gift, my campaign treasurer will be required to give the
money to a nonprofit organization.
FISCAL IMPACTS:
Minor administrative costs connected with accounting for special funds.
Depending on how the funds are spent, may free up otherwise obligated City
funds.
