BACKGROUND: The BIA has long been concerned over the number of dogs that are brought to the Thursday Night Activities and Farmers' Market. As crowds have grown, so has the proliferation of dogs. In the past there have been minor problems with dogs entering stores and bothering patrons. Recently, however, several situations have arisen that interfere with public safety and health, and the BIA issued a ban on dogs at the Thursday night event in mid-August. The major areas of concern are the safety and comfort of our families and sanitation. Also at issue is the potential liability of both the BIA and the City. There has been considerable public discussion about this issue in the media, the preponderance of which is in favor of the ban. Most Thursday night patrons have been willing to leave their dogs at home, but because a few people refuse to adhere to the ban, there is a need for an enforcement tool. The proposed ordinance would allow the Police Department to enforce the prohibition of dogs. Attachments ORDINANCE NO. (1988 SERIES) AN ORDINANCE ADDING SECTION 6.20.050C TO THE SAN LUIS OBISPO MUNICIPAL CODE PROHIBITING DOGS ON PUBLIC STREETS DURING SPECIAL EVENTS BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. Section 6.20.050C. is hereby added to the San Luis Obispo Municipal Code to read as follows: . "C. Notwithstanding any other provision of' this code, no person shall allow any dog, whether on a leash or not, to be on any public street, alley, lane, sidewalk, or other place open to and used by the public and for which an encroachment, sidewalk or street closure, or similar permit has been issued and the person(s) holding said permit have given reasonable notice that the presence of any dogs would interfere with the purposes for which the permit was issued. This prohibition. shall. not apply to guide or seeing-eye dogs."
