EE 4QJ1JF§� J city of San Luis OBISpo Oct.4, 988 COUNCIL AGENDA REPORT Mun957 FROM: Ann Crossey, Personnel Director SUEUECT: Memorandum of Agreement between the City of San Luis Obispo and the SLO Fire Battalion Chiefs' Association for the period of 1 July 1988 - 30 June 1993. CAO RECOMMENDATION: Adopt resolution approving the Memorandum of Agreement BACKGROUND: During the last negotiations between the Firefighters Association and the City it was mutually agreed that the Chief Officer positions might be better handled in a different bargaining unit than in the same unit as the firefighters, engineers and captains which they supervise. The M.O.A. reads as follows: During the months of November and December of 1987, the City and the battalion chiefs shall meet to discuss representation options available to the battalion chiefs. This discussion will include the concerns and interests of both the City and the battalion chiefs. Once the battalion chiefs have this information it will be their option to file a petition to be removed from this Unit for the balance of the term of the Agreement. The Battalion Chief positions, are exempt positions and excluded from both overtime pay and mandated overtime pay required by the Fair Labor Standards Act* (FLSA) which are enjoyed by all other sworn members in the Unit. In regards to external comparisons, we were beginning to fall behind in comparisons with our agreed upon survey agencies during the last five years. Lastly, the managerial duties and professional job requirements were increasing significantly for these positions. For example, everyone is aware of the expanding demands on the Fire Marshal's position. As the Chief Officers were not allowed to participate in negotiations as unit representatives, there was a shared perception that their concerns and exempt status were not fully considered during the negotiations process. We agreed to address their compensation concerns in 1988 after appropriate unit determinations had been made. They voted to become a separate unit. This is the first agreement between the City and the Battalion Chiefs and was prepared with the mutually cooperation of the Battalion Chiefs, the Fire Chief, the CAO's office and Personnel. It is consistent with and comparable to the Police Staff Officers Agreement. The additional raises for 1988 and 1989 are to place them in a competitive position both internally and externally and also to reflect the reduction in compensatory time off and the managerial and exempt status of these positions. * FLSA requires all hours worked by sworn fire personnel over 53 in a week to be paid at time and one half. (Suppression personnel normally work a regular 56 hour week. Therefore, all non-exempt sworn personnel received a federally mandated pay increase, for normal work, which the Chief Officers did not). SIGNIFICANT ITEMS/CHANGE Term: 5 years 1 July 88 - 30 June 93 Salary Year 7-1-88 Across the Board increase of 6%• 1-1-89 Across the Board increase of 3% Year 2 7-1-89 Across the Board increase of 8.4% 1-1-90 Across the Board increase of 2% Year 7-1-90 Across the Board increase of 4% 1-1-91 Across the Board increase of 3% Year 4 7-1-91 Across the Board increase of 4% 1-1-92 Across the Board increase of 3% Year 7-1-92 Across the Board increase of 4% 1-1-93 Across the Board increase of 3% Insurance Funding for the medical insurance premiums shall be increased from $257.40 to $300.00 per month effective December 1988 and to $325.00 per month effective December 1990 and to $350.00 effective December 1992. Uniform Allowance: The Uniform Allowance shall remain $500 for 1988 and increase to $600 July 1, 1989. MISCELLANEOUS: These positions will no longer earn and accrue compensatory time off, (CTO) except as specifically provided as administrative leave, in Article 18, commencing 1 September 88. All CTO recorded to this date shall be paid off at the hourly rate effective 30 June 88. This will significantly reduce CTO for these positions and offsets the salary increases. (The salaries will be higher but less CTO time.) The administrative leave granted exempt employees shall be 64 hours per year effective September 1988. Effective in 1990 up to 40 hours of unused administrative leave may be taken as pay. The Association and City agree that the agencies used for comparison purposes for management positions shall be used for comparison purposes for the battalion chief positions. FISCAL IMPACT: Current total annual compensation costs for the Fire Battalion Chiefs' unit are approximately $330,700. Cost increases under the proposed M.O.A. are projected at $25,300 (7.755) for 1988-89; $38,800 (10.9%) for 1989-90; $25,700 (6.596) for 1990-91; $28,400 (6.856) for 1991-92; and $31,400 (7.096) for 1992-93. RECOMMENDATION: Adopt resolution approving the Memorandum of Agreement. RESOLUTION NO. (1988 SERIES) A RESOIUTION OF THE COUNCIL OF TSE CITY OF SAN IDIS OBISPO ADOPTING AND RATIFYING THE MEM ANDUM OF ASI' BEDMEN THE CITY OF SAN IDIS OBISPO AND THE SAN LUIS OBISPO FIRE BAMUZON CHIEFS' ASSOCIATION FOR THE PERIOD OF JULY 1, 1988 - JUNE 30, 1993. BE IT RESOLVED by the Cm mail of the City of San ,iuis Obispo as follows: Section 1. The Memorandnmm of Agreement between the City of San Luis Obispo and the San Luis Obispo Fire Battalion Chiefs' Association, attached hereto as Exhibit "A" and incorporated herein by this reference, is hereby adopted and ratified. Section 2.. The Finance Director shall increase the Personnel Services appropriation accounts to reflect the negotiated coapensation dmrigm. Section 3.
