SUBJECT: Plans and Specifications for "Sidewalk Improvement
Project: Santa Barbara Street - Church Street to
Morro Street, City Plan No. R-40B"
RECOMMENDATION: By motion determine desired alternative, approve
plans and specifications, authorize staff to
advertise for bids, and authorize CAO to award
contract if bids are lower than Engineer's estimate
BACKGROUND:
At its meeting of September 18, 1990, the City Council determined by
Resolution. No. 6871 that public interest, convenience, and necessity
require the construction of the improvements.
The property owner was notified in accordance with provisions of the
Code and failed to install the required improvements. Therefore,
following provisions of the Code, staff has prepared these contract
documents to have the work done.
Plans and specifications were presented for Council consideration at
the meeting of April 3, 1991. At that meeting a question was raised as
to whether it would be more desirable to install a detached sidewalk in
this Old Town neighborhood property, so as to allow for a planting area
between the curb and the sidewalk. Staff was directed to prepare an
alternate plan to reflect this concern.
DISCUSSION:
In preparing the original plan, staff was governed by Resolution
No. 1512 (1965 Series) which calls for integral sidewalk, except
A) if one-half or more of any block is already improved with separated
sidewalks; or B) in the event of unusual circumstances. Public Works
staff could not find that the situation was an unusual circumstance;
therefore following direction of the resolution, the improvements were
designed for integral sidewalk.
In preparing the alternate plan staff has still maintained the integral
sidewalk at the bus pullout, since it is critical to have continuous
sidewalk from the vehicle to the through walking area and the bus
bench. The detached sidewalk is designed only for the more southerly
150' of the property. Because of the necessity to relocate a fence,
the alternate will cost approximately $150 more than the original
design. This will be paid for by the property owner. Although the
planting area does permit landscaping, including trees, the 1911 Act
does not recuire that the area be landscaped or planted. In fact, one
of the basic reasons that the Council adopted the resolution in 1965
was that most property

owners failed to adequately maintain the area between the curb and the
sidewalk. Since this is a rental property, and beyond a fence from the
house, it is quite likely that this planter area would not be i
maintained.

RECOMMENDATION:

Staff continues to feel that best service to the neighborhood is the
least expensive alternate the integral sidewalk, and so recommends.

RESOLUTION NO . 1512 ( 1965 Series)
A RESOLUTION ESTABLISHING POLICY FOR
SIDEWALK CONSTRUCTION
BE IT RESOLVED by the Council of the City of San Luis Obispo as follows:
1. That all public sidewalks hereafter constructed in the City of San Luis Obispo
shall be integral except upon approval of the City Engineer under the following circumstances:
A. If one-half or more of any block is already improved with separated
sidewalks; or
B. In the event of unusual circumstances.
